【摘要】：黨的十八大以來,習(xí)近平總書記發(fā)表了一系列關(guān)于法治方面的專題講話。在十八屆四中全會(huì)中又提出全面推進(jìn)依法治國的總目標(biāo)。社會(huì)主義國家進(jìn)入新的探索時(shí)期,在肯定經(jīng)濟(jì)發(fā)展取得巨大進(jìn)步,人民生活水平日益提高所取得成績的同時(shí),也應(yīng)意識(shí)到從依法治國目標(biāo)的建立到法治國家的真正實(shí)現(xiàn),尚還存在一些不相適應(yīng)的情況,要想逾越二者之間的鴻溝,必須分解任務(wù)目標(biāo),分步實(shí)施,最終實(shí)現(xiàn)社會(huì)主義法治國家的建立。其中地方政府作為國家機(jī)器的重要組成部分,其行為規(guī)范與否事關(guān)民生福祉。國家政策的上傳下達(dá),民眾意愿的匯集,都需要通過地方政府貫徹實(shí)施,所以沒有地方政府行為的規(guī)范,就難有社會(huì)治理的和諧,更談不上依法治國、法治國家的建立。當(dāng)前由于經(jīng)濟(jì)發(fā)展過快,導(dǎo)致社會(huì)浮躁、急功近利心態(tài)出現(xiàn)在部分政府官員身上,再加上權(quán)力配置過于集中,執(zhí)行層面法律制度規(guī)則不完善,民眾政治參與有效性不佳,缺乏監(jiān)督約束機(jī)制,出現(xiàn)了偏離法制軌道和公共目標(biāo)的政府失范行為。其主要體現(xiàn)為地方政府機(jī)構(gòu)創(chuàng)收、官員考核唯GDP論的商業(yè)化行為、決策“隨機(jī)主義”傾向嚴(yán)重及行政執(zhí)法不規(guī)范的短視政府行為以及黨中央高度重視的官員作風(fēng)腐化行為等,集中反映了在實(shí)際生活中其遇到的困難與挑戰(zhàn)。我們針對地方政府失范行為必須加以規(guī)范約束,轉(zhuǎn)變地方政府職能,深化行政體制改革,完善政府內(nèi)部制度,提高黨員干部法治思維和依法執(zhí)政的水平,建立健全權(quán)力監(jiān)督制衡機(jī)制;同時(shí)全面推進(jìn)政務(wù)公開及基層治理法治化,拓寬民眾政治參與渠道,提高民眾參政議政意識(shí),官民同心,自覺堅(jiān)持并且扎實(shí)推進(jìn)依法治國進(jìn)程,努力實(shí)現(xiàn)地方政府法治化建設(shè),進(jìn)而逐步實(shí)現(xiàn)法治國家建立。
[Abstract]:Xi Jinping has delivered a series of special speeches on the rule of law since the 18th CPC National Congress. At the fourth Plenary session of the 18th CPC Central Committee, the general goal of comprehensively promoting the rule of law was put forward. When socialist countries enter a new period of exploration, while affirming the achievements made in the economic development and the increasing improvement of the living standards of the people, they should also be aware of the real realization from the establishment of the goal of governing the country by law to the realization of a country governed by the rule of law, In order to overcome the gap between the two, it is necessary to break down the task objectives, implement them step by step, and finally realize the establishment of a socialist country ruled by law. Local government as an important part of the national machinery, its behavior norms or not related to the well-being of the people. The uploading and issuing of national policy and the collection of people's will need to be carried out through local government, so without the norms of local government's behavior, it is difficult to have the harmony of social governance, let alone the rule of law and the establishment of a country ruled by law. At present, due to the rapid economic development, the society is impetuous, and the mentality of quick success and instant profit appears on some government officials. In addition, the allocation of power is too centralized, the rules of the legal system at the executive level are not perfect, and the effectiveness of the people's political participation is not good. In the absence of supervision and restraint mechanism, the government deviates from the track of legal system and the public target. They are mainly reflected in the income generation of local government institutions, the commercialized behavior of the GDP theory of officials' examination, the short-sighted government behavior with a serious tendency of "randomism" in decision-making and non-standard administrative law enforcement, and the corrupt behavior of officials' style of work that the CPC Central Committee attaches great importance to, and so on. It reflects the difficulties and challenges in real life. We must regulate and constrain local government misconduct, transform the functions of local governments, deepen the reform of the administrative system, perfect the internal system of the government, and improve the thinking of party members and cadres on the rule of law and the level of ruling by law. Establishing and perfecting the mechanism of power supervision and checks and balances; At the same time, we should comprehensively promote the openness of government affairs and the rule of law at the grass-roots level, broaden the channels of popular political participation, raise the awareness of the people to participate in and discuss political affairs, conscientiously adhere to and firmly promote the process of governing the country according to law, and strive to realize the construction of local government by law. Then gradually realize the establishment of a country ruled by law.
