開發(fā)區(qū)管委會行政主體資格研究

【摘要】:三十年前的秋天,當大連成立了我國第一個開發(fā)區(qū)的時候,誰都不敢想象,經(jīng)過幾代開發(fā)區(qū)人不斷摸索總結(jié)、改革發(fā)展、創(chuàng)新完善,開發(fā)區(qū)已然成為我國經(jīng)濟轉(zhuǎn)型探索的先行者,成為了國家經(jīng)濟領(lǐng)域改革轉(zhuǎn)型的重要模式和不可小覷的中堅力量。三十年后的今天,當擁有經(jīng)開區(qū)、高新區(qū)、進出口加工區(qū)、保稅區(qū)、自貿(mào)區(qū)、旅游區(qū)等多種類、多級別的開發(fā)區(qū)在我國生根發(fā)芽、遍地開花的時候,開發(fā)區(qū)成為了所在地人民政府轉(zhuǎn)移失地農(nóng)民的主要渠道、解決大學(xué)生就業(yè)的主要市場、政策傾斜和扶持主要戰(zhàn)場。三十年彈指一揮間,開發(fā)區(qū)已經(jīng)成為地方經(jīng)濟增長的穩(wěn)定引擎和重要保障,成為我國經(jīng)濟高速發(fā)展、產(chǎn)業(yè)優(yōu)化轉(zhuǎn)型升級的主力軍。然而,與開發(fā)區(qū)經(jīng)濟欣欣向榮的生動局面形成巨大對比的是法制方面的動作可謂一潭死水。至今,國家層面都沒有頒布一部開發(fā)區(qū)法,只有地方各級人大或人民政府出臺過關(guān)于各自開發(fā)區(qū)的地方性法規(guī)和行政規(guī)章,大多因為沒有上位法做出原則性的規(guī)定,導(dǎo)致這些地方性法規(guī)和行政規(guī)章有太多的地方特色,且隨意性相當大。正是因為法律的缺位,導(dǎo)致管委會的行政主體資格不能得到很明確的界定,這使得在實際操作中,管委會遭遇了很多困難。本文擬通過闡述我國開發(fā)區(qū)的管理模式和管委會的職能,論述管委會在實際運行中遇到的現(xiàn)實困難,界定管委會的性質(zhì),探討管委會面臨法律地位的尷尬,剖析管委會行政主體資格,列出筆者對該問題的一些思考和法律建議。文章的第一部分主要介紹我國開發(fā)區(qū)管委會的主要管理模式、職能和開發(fā)區(qū)管委會在實際運作中存在的現(xiàn)實困境;文章第二部分筆者闡述了確認行政主體資格的方法,并通過對比探討了我國管委會應(yīng)不應(yīng)該是一個行政主體,在此基礎(chǔ)上對管委會的做了定性分析;文章第三部分筆者通過《地方組織法》、開發(fā)區(qū)法、地方行政規(guī)章三個角度對我國開發(fā)區(qū)管委會行政主體資格提出立法建議,最后提出加強監(jiān)督的建議。
[Abstract]:Thirty years ago, when Dalian set up the first development zone in China, no one could imagine it. After several generations of people fumbling and summing up, it was reformed, developed, innovated and perfected. The development zone has become the pioneer of the exploration of economic transformation in our country, and has become the important mode and the backbone force of the reform and transformation of the national economic field. Today, 30 years later, when there are many kinds of, multi-level development zones in China, such as open development zones, high-tech zones, import and export processing zones, bonded zones, free trade zones, tourism zones, and so on, they have taken root and sprouted everywhere in our country. The development zone has become the main channel for the local people's government to transfer the land-lost peasants, to solve the main market for college students' employment, and to tilt the policy and support the main battlefield. In 30 years, the development zone has become the stable engine and important guarantee of the local economic growth, and has become the main force of the rapid economic development and industrial transformation and upgrading of our country. Yet, in contrast to the dynamic economic boom in the development zone, the legal system is stagnant. Up to now, no national level has promulgated a law on development zones. Only local people's congresses or people's governments at various levels have issued local laws and administrative regulations on their respective development zones. These local regulations and administrative regulations have too many local characteristics, and are quite arbitrary. It is precisely because of the absence of the law that the administrative subject qualification of the Administrative Committee cannot be clearly defined, which makes the Commission encounter a lot of difficulties in practice. This paper expounds the management mode of the development zone and the functions of the management committee in China, discusses the practical difficulties encountered by the management committee in its actual operation, defines the nature of the management committee, and probes into the embarrassing legal status faced by the management committee. This paper analyzes the qualification of the administrative subject of the Administrative Committee, and lists some thoughts and legal suggestions of the author on this issue. The first part of the article mainly introduces the main management mode, functions and practical difficulties of the development zone management committee in China. In the second part of the article, the author expounds the method of confirming the qualification of administrative subject, and probes into whether the administrative committee of our country should be an administrative subject or not, on the basis of which the qualitative analysis is made to the administrative committee. In the third part of the article, the author puts forward legislative suggestions on the qualification of the administrative subject of China's development zone management committee from three angles of "Local Organic Law", "Development Zone Law" and "Local Administrative regulations", and finally puts forward some suggestions on strengthening supervision.
