軟法視角下的社會(huì)公益組織治理

【摘要】:當(dāng)前,中國(guó)社會(huì)公益組織進(jìn)入了一個(gè)高速發(fā)展期,隨之也出現(xiàn)了一系列社會(huì)公益組織的丑聞事件;谥袊(guó)社會(huì)公益組織治理現(xiàn)狀的困境,本文首先通過(guò)對(duì)社會(huì)公益組織概念的分析,明確了全文的研究對(duì)象,接著通過(guò)對(duì)國(guó)內(nèi)外各理論的闡述,初步界定了何為本文語(yǔ)境意欲引用加以討論的軟法。本文進(jìn)而分析了針對(duì)社會(huì)公益組織治理的現(xiàn)實(shí)需求,解析了中國(guó)語(yǔ)境下當(dāng)前社會(huì)公益組織治理體制的缺陷:準(zhǔn)入控制過(guò)嚴(yán)、立法滯后、稅收激勵(lì)不足、政府監(jiān)管缺位,并且剖析了其失敗的癥結(jié)所在:對(duì)中國(guó)社會(huì)公益組織定位的錯(cuò)誤。 在社會(huì)公益組織治理硬法失敗的前提下,本文通過(guò)引入軟法為視角,考察了軟法對(duì)社會(huì)公益組織各監(jiān)管方的激勵(lì)。對(duì)各方監(jiān)管激勵(lì)的分析,一方面是對(duì)軟法在當(dāng)前社會(huì)公益組織治理中運(yùn)用的描述,另一方面,又是之后對(duì)運(yùn)用軟法設(shè)計(jì)治理社會(huì)公益組織制度的發(fā)展方向;诟鱾(gè)監(jiān)管者具備的不同激勵(lì)動(dòng)機(jī),本文進(jìn)而提出了一系列不同于傳統(tǒng)硬法的社會(huì)公益組織治理新進(jìn)路,如建立社會(huì)公益組織自治章程備案制度、構(gòu)建社會(huì)公益組織內(nèi)部軟法制定的程序等具體措施,有針對(duì)性地解決各方的監(jiān)管激勵(lì)不足問(wèn)題,并且能夠?qū)嶋H對(duì)準(zhǔn)入控制、立法科學(xué)化、稅收激勵(lì)等做出相應(yīng)的軟法解決。本文的結(jié)論并非傳統(tǒng)的加強(qiáng)立法、增強(qiáng)監(jiān)管等口號(hào)式硬法主張,而是更加務(wù)實(shí)地,試圖通過(guò)引入軟法的進(jìn)路,通過(guò)在治理中將軟法與硬法相結(jié)合起來(lái),在當(dāng)前硬法體制還不能夠有重大突破改善的情況下,通過(guò)軟法的進(jìn)路來(lái)緩解現(xiàn)實(shí)治理社會(huì)公益組織的壓力,以期對(duì)解決中國(guó)社會(huì)公益組織治理問(wèn)題做出具有創(chuàng)新性的回應(yīng)。
[Abstract]:At present, China's social welfare organizations have entered a period of rapid development, followed by a series of scandals of social welfare organizations. Based on the current situation of the governance of social public welfare organizations in China, this paper firstly analyzes the concept of social public welfare organizations, defines the research object of the full text, and then expounds the various theories at home and abroad. This paper preliminarily defines what is the soft law to be discussed in the context of this paper. This paper then analyzes the actual needs of the governance of social public welfare organizations, and analyzes the defects of the current governance system of social public welfare organizations in the context of China: too strict access control, lagging legislation, inadequate tax incentives, lack of government supervision, and so on. And analyzed the crux of its failure: the positioning of China's social welfare organizations wrong. Under the premise of the failure of the hard law governing the social public welfare organization, this paper, from the perspective of introducing the soft law, investigates the incentive of the soft law to the supervisors of the social public welfare organization. On the one hand, it describes the application of soft law in the governance of social public welfare organizations, on the other hand, it is the development direction of designing and managing the system of social public welfare organizations with soft law. Based on the different motivations of the regulators, this paper puts forward a series of new approaches to the governance of social public welfare organizations, such as the establishment of the self-regulation system of social public welfare organizations, which is different from the traditional hard law. The concrete measures such as constructing the procedure of soft law making in social public welfare organization can solve the problem of insufficient supervision and incentive of all parties, and can make the corresponding soft law solution on the basis of actual control, scientific legislation, tax incentive and so on. The conclusion of this paper is not the slogan hard law proposition such as strengthening legislation and strengthening supervision, but more pragmatically, trying to combine soft law with hard law through introducing soft law, and combining soft law with hard law in governance. Under the condition that the hard law system can not be improved, the pressure of managing social public welfare organization can be alleviated by soft law approach, in order to make an innovative response to the problem of Chinese social public welfare organization governance.
