【摘要】：獨(dú)生子女政策抑制了人口的爆炸式增長(zhǎng),但另一方面,對(duì)嚴(yán)格執(zhí)行獨(dú)生子女政策后子女卻意外傷殘或死亡的家庭更是付出了慘痛的代價(jià),失獨(dú)家庭的訴求逐漸成為社會(huì)熱點(diǎn)。本文分四部分系統(tǒng)闡述失獨(dú)家庭的扶助問(wèn)題。第一部分:從兩個(gè)方面闡述失獨(dú)家庭的政府扶助義務(wù)。一方面,失獨(dú)群體面臨著各種困境一精神創(chuàng)傷、養(yǎng)老擔(dān)憂(yōu)、經(jīng)濟(jì)困難、婚姻關(guān)系危機(jī)等等。另一方面,基于特別犧牲理論、風(fēng)險(xiǎn)社會(huì)理論、國(guó)家責(zé)任論、平等權(quán)理論四個(gè)視角為國(guó)家扶助失獨(dú)家庭提供理論依據(jù)。第二部分:從四個(gè)方面分析我國(guó)失獨(dú)家庭國(guó)家扶助的現(xiàn)狀及問(wèn)題。第一,失獨(dú)家庭扶助制度的發(fā)展歷程概括為三個(gè)階段:國(guó)家扶助制度的初期、特別扶助制度的確立、特別扶助制度的發(fā)展。第二,概括中央層面失獨(dú)家庭扶助制度的不足:失獨(dú)家庭扶助制度依據(jù)單一化、缺少對(duì)失獨(dú)家庭養(yǎng)老問(wèn)題扶助的系統(tǒng)性規(guī)定、扶助對(duì)象范圍太窄、失獨(dú)家庭扶助制度缺乏完整的框架、扶助對(duì)象認(rèn)定程序的不科學(xué)。第三,從精神撫慰、養(yǎng)老方面、扶助金方面、扶助范圍上比較失獨(dú)家庭的地方扶助方案。第四,歸納總結(jié)出地方扶助失獨(dú)家庭存在的不足,包括政府信息公開(kāi)和宣傳不到位、地方特別扶助標(biāo)準(zhǔn)差異大、養(yǎng)老問(wèn)題突出、精神撫慰和心理疏導(dǎo)欠缺、政策的銜接問(wèn)題、利益表達(dá)機(jī)制的欠缺。第三部分:總結(jié)出扶助失獨(dú)家庭的措施。依托《計(jì)劃生育特殊家庭扶助條例》建構(gòu)法律保障框架;以社會(huì)團(tuán)體作為利益表達(dá)渠道;在處理好《慈善法》與《社會(huì)救助暫行辦法》銜接的同時(shí)以慈善救助為補(bǔ)充保障機(jī)制。第四部分:針對(duì)失獨(dú)家庭的特殊性,提出《計(jì)劃生育特殊家庭扶助條例》的完善重點(diǎn)。第一,優(yōu)化扶助對(duì)象認(rèn)定程序、范圍和扶助金。第二,完善養(yǎng)老措施和精神慰藉方式。第三,重視社會(huì)力量的參與。第四,加強(qiáng)對(duì)扶助制度實(shí)施的監(jiān)督。
[Abstract]:The one-child policy inhibits the explosive growth of the population, but on the other hand, the families who have accidental disability or death after the strict implementation of the one-child policy have paid a painful price, and the demand for the lost family has gradually become a hot spot. This article is divided into four parts to explain the assistance problem of the single family.
