江蘇海事局基層執(zhí)法機(jī)構(gòu)設(shè)置與人員配備標(biāo)準(zhǔn)研究

【摘要】:行政體制是國(guó)家體制的重要組成部分,行政體制改革是全面深化改革的關(guān)鍵環(huán)節(jié)。伴隨經(jīng)濟(jì)體制、政治體制、文化體制、社會(huì)體制等改革的不斷推進(jìn),行政體制改革不斷深化,取得了顯著成效。十七大報(bào)告中談到堅(jiān)定不移發(fā)展社會(huì)主義民主政治時(shí)指出:“加快行政管理機(jī)制改革,建設(shè)服務(wù)型政府”,“服務(wù)型政府”一詞首次寫入黨的報(bào)告,標(biāo)志著服務(wù)型政府已經(jīng)成為中國(guó)行政管理機(jī)制改革的建設(shè)目標(biāo)。十八大強(qiáng)調(diào),行政體制改革是推動(dòng)上層建筑適應(yīng)經(jīng)濟(jì)基礎(chǔ)的必然要求。要按照建立中國(guó)特色社會(huì)主義行政體制目標(biāo),深入推進(jìn)政企分開、政資分開、政事分開、政社分開,建設(shè)職能科學(xué)、結(jié)構(gòu)優(yōu)化、廉潔高效、人民滿意的服務(wù)型政府。2013年直屬海事系統(tǒng)開展了 “三定”工作,各級(jí)機(jī)構(gòu)的內(nèi)設(shè)機(jī)構(gòu)設(shè)置基本完善,基層執(zhí)法機(jī)構(gòu)的設(shè)置和人員編制在“三定”中有所變化,但基層一線派出機(jī)構(gòu)和辦事站點(diǎn)的設(shè)置基本維持了水監(jiān)體制改革的初期規(guī)模。為了進(jìn)一步推進(jìn)轉(zhuǎn)化政府職能、簡(jiǎn)政放權(quán)的行政審批制度改革,2015年交通運(yùn)輸部海事局決定取消船舶進(jìn)出港簽證。由于海事基層執(zhí)法機(jī)構(gòu)的設(shè)置多年未進(jìn)行調(diào)整,導(dǎo)致目前“三定”后基層執(zhí)法機(jī)構(gòu)設(shè)置與簽證取消、海事監(jiān)管重心向事中事后轉(zhuǎn)變等新要求不完全匹配、人員配置不盡合理,對(duì)外造成工作不暢,對(duì)內(nèi)制約海事業(yè)務(wù)工作正常開展。此外,推進(jìn)依法治國(guó)、簡(jiǎn)政放權(quán)和海事“三化”建設(shè)也對(duì)基層執(zhí)法機(jī)構(gòu)如何適應(yīng)新的形勢(shì),高效運(yùn)轉(zhuǎn),有效履職,更好地提供優(yōu)質(zhì)的海事公共服務(wù)也提出了新的要求。面對(duì)持續(xù)推進(jìn)簡(jiǎn)政放權(quán)、放管結(jié)合、優(yōu)化服務(wù),不斷提高政府效能和取消船舶進(jìn)出港簽證、執(zhí)法資源向基層一線傾斜、監(jiān)管重心向事中事后轉(zhuǎn)變等新形勢(shì),江蘇海事局如何依托基層海事執(zhí)法機(jī)構(gòu)的設(shè)置和人員配置實(shí)現(xiàn)有效監(jiān)管,提供優(yōu)質(zhì)的海事公共服務(wù),值得研究。本文從公共管理的視角,運(yùn)用行政體制和公共人力資源管理理論成果,探討如何提升基層執(zhí)法機(jī)構(gòu)有效履職能力,提供優(yōu)質(zhì)的海事公共服務(wù)。通過(guò)分析江蘇海事局基層執(zhí)法機(jī)構(gòu)設(shè)置與人員配備標(biāo)準(zhǔn)存在的問(wèn)題,對(duì)海事處、直屬辦事處業(yè)務(wù)工作影響因素的統(tǒng)計(jì)分析,參考專家調(diào)查問(wèn)卷結(jié)果,通過(guò)綜合各類影響因素的加權(quán)計(jì)算平衡,制定了基層執(zhí)法機(jī)構(gòu)的機(jī)構(gòu)設(shè)置標(biāo)準(zhǔn),前瞻性地探索船舶簽證取消后基層執(zhí)法機(jī)構(gòu)可能面臨的調(diào)整,形成四類不同的基層執(zhí)法機(jī)構(gòu)標(biāo)準(zhǔn),并通過(guò)一系列運(yùn)行機(jī)制予以保障。在對(duì)基層執(zhí)法機(jī)構(gòu)進(jìn)行分類定級(jí)的基礎(chǔ)上,按照人員履職分工進(jìn)行職位設(shè)置,參考借鑒直屬海事系統(tǒng)沿用的有關(guān)基層執(zhí)法機(jī)構(gòu)機(jī)構(gòu)編制和配布條件及設(shè)施設(shè)備配備標(biāo)準(zhǔn)中對(duì)機(jī)構(gòu)設(shè)置、人員編制的測(cè)算方法,結(jié)合基層執(zhí)法機(jī)構(gòu)職位設(shè)置,側(cè)重建立人員配備模型公式和彈性調(diào)整方法,按照四類基層執(zhí)法機(jī)構(gòu)研究設(shè)計(jì)了基層執(zhí)法機(jī)構(gòu)的崗位設(shè)置和人員配備標(biāo)準(zhǔn)。
[Abstract]:The administrative system is an important part of the national system, and the reform of the administrative system is the key link to deepen the reform in an all-round way. With the development of economic system, political system, cultural system and social system, the reform of administrative system has been deepened and achieved remarkable results. The report of the Seventeenth National Congress on unswervingly developing socialist democratic politics pointed out: "speeding up the reform of the administrative mechanism and building a service-oriented government," and the term "service-oriented government" is for the first time written into the party's report. Service-oriented government has become the goal of administrative mechanism reform in China. The 18th National Congress stressed that the reform of the administrative system is an inevitable requirement for the superstructure to adapt to the economic base. In accordance with the goal of establishing a socialist administrative system with Chinese characteristics, we must further promote the separation of government and enterprise, separation of government from capital, separation of government from affairs, separation of government and social affairs, scientific construction functions, optimization of structure, and integrity and efficiency. A service-oriented government that is satisfied with the people. In 2013, the maritime system directly under its authority launched the work of "three regulations," and the internal establishment of institutions at all levels was basically improved, and the setting up and staffing of law enforcement agencies at the grass-roots level changed in the "three regulations." Since the establishment of the basic maritime law enforcement agencies has not been adjusted for many years, the new requirements of setting up and cancelling visas for the grassroots law enforcement agencies after the "three orders", changing the focus of maritime supervision to the post event, and so on, are not fully matched, and the staffing is not entirely reasonable. In addition, to promote the rule of law, simplify the administration of power and maritime "three" construction also put forward new requirements for grass-roots law enforcement agencies how to adapt to the new situation, efficient operation, effective performance of their duties, and better provide high-quality maritime public services. In the face of the new situation of continuously promoting the decentralization of government power, combining release with management, optimizing services, continuously improving government efficiency and cancelling entry and exit visas for ships, tilting law enforcement resources to the grass roots, and shifting the focus of supervision to the post event, and so on, It is worth studying how Jiangsu Maritime Safety Bureau relies on the establishment and staffing of the basic maritime law enforcement agencies to achieve effective supervision and provide high-quality maritime public services. From the perspective of public management, this paper discusses how to improve the ability of law enforcement agencies at the grass-roots level to carry out their duties effectively and to provide high-quality maritime public services by using the administrative system and the theoretical achievements of public human resources management. By analyzing the problems existing in the establishment and staffing standards of the basic law enforcement agencies of Jiangsu Maritime Affairs Bureau, and the statistical analysis of the factors affecting the operational work of the Marine Department and the directly affiliated offices, and referring to the results of the expert questionnaire, By synthesizing the weighted calculation and balance of all kinds of influence factors, we have formulated the standards for setting up the law enforcement agencies at the grass-roots level, and have prospectively explored the adjustments that may be faced by the law enforcement agencies at the grass-roots level after the cancellation of ship visas. Form four different basic law enforcement standards, and through a series of operational mechanisms to ensure.
