【摘要】：如今,網(wǎng)約車作為出租汽車出行的新方式,在我國已經(jīng)得到廣泛普及。然而,網(wǎng)約車近年來發(fā)展出現(xiàn)了各種問題,引發(fā)了社會熱議,更讓社會對于網(wǎng)約車相關(guān)準入機制和政府監(jiān)管相關(guān)法律法規(guī)有了更大的期待。經(jīng)過多年的研究制定,2016年底,我國交通運輸部和包括北京市在內(nèi)的各主要地區(qū)交通主管部門相繼發(fā)布了網(wǎng)約車的經(jīng)營服務(wù)管理辦法。然而這些法律文件的出臺不僅沒有打消公眾疑慮,其準入機制和政府監(jiān)管的內(nèi)容反而引發(fā)了社會爭議和部分行業(yè)主體的反對。本文從網(wǎng)約車發(fā)展的大趨勢出發(fā),在明確網(wǎng)約車性質(zhì)的基礎(chǔ)上,通過對北京市網(wǎng)約車現(xiàn)行準入機制和政府監(jiān)管活動的現(xiàn)狀、問題的分析,就如何完善北京市網(wǎng)約車準入機制和政府監(jiān)管提出了針對性建議,為北京市網(wǎng)約車設(shè)計了互聯(lián)網(wǎng)監(jiān)管系統(tǒng)。本文除去緒論和結(jié)語,共分為四個部分:第一部分,對巡游車、網(wǎng)約車、準入機制和政府監(jiān)管的相關(guān)概念進行了界定,對相關(guān)的理論進行了闡述,以期為分析北京市網(wǎng)約車準入機制和政府監(jiān)管存在的問題提供理論基礎(chǔ)。第二部分“北京市網(wǎng)約車準入機制研究”,該部分主要對我國巡游車和網(wǎng)約車準入機制的內(nèi)容進行了闡述和對比,分析北京市網(wǎng)約車準入機制的現(xiàn)狀,表明了準入機制行的突出問題并提出了對策。第三部分“北京市網(wǎng)約車政府監(jiān)管研究”,該部分分析了北京市網(wǎng)約車政府監(jiān)管中存在的問題及原因,并就問題提出了解決對策。第四部分“北京市網(wǎng)約車互聯(lián)網(wǎng)監(jiān)管系統(tǒng)設(shè)計”,該部分分析互聯(lián)網(wǎng)對于政府監(jiān)管的意義,設(shè)計適合北京市網(wǎng)約車使用的互聯(lián)網(wǎng)監(jiān)管系統(tǒng),闡述了該系統(tǒng)的運行機制,分析了建立互聯(lián)網(wǎng)監(jiān)管系統(tǒng)的意義。
[Abstract]:Nowadays, as a new way to travel by taxi, it has been widely used in our country. However, in recent years, there have been a variety of problems in the development of ride-hailing, which has caused a heated discussion in the society, which makes the society have a greater expectation for the access mechanism and the relevant laws and regulations of the government. By the end of 2016, the Ministry of Communications and Transportation of China and the transportation authorities of major regions, including Beijing, have successively issued the management measures for the operation and service of net-chartered vehicles. However, the introduction of these legal documents has not only not reassured the public, but also triggered social disputes and opposition from some industry subjects by the entry mechanism and the contents of government supervision. Based on the general trend of the development of net-ride-hailing, and on the basis of clarifying the nature of net-ride-hailing, this paper analyzes the current situation and problems of the current access mechanism and the government supervision activities of the net-ride-hailing in Beijing. This paper puts forward some suggestions on how to perfect the access mechanism and the government supervision of Beijing's ride-hailing network, and designs an Internet supervision system for Beijing's net-ride-hailing system. Apart from the introduction and conclusion, this paper is divided into four parts: the first part defines the related concepts of cruise vehicle, net car, access mechanism and government supervision, and expounds the relevant theories. In order to provide a theoretical basis for the analysis of the access mechanism and the problems of government supervision. The second part is "the Research on the access Mechanism of Beijing Net-chartered car". This part mainly expounds and compares the contents of the access mechanism of China's tour vehicle and the net-chartered car, and analyzes the present situation of the access mechanism of Beijing's Net-chartered car. This paper shows the outstanding problems of access mechanism and puts forward some countermeasures. The third part is "the Research on the Government Regulation of Beijing Net-chartered car". This part analyzes the problems and causes in the government supervision of Beijing Net-chartered car, and puts forward some countermeasures to solve the problems. The fourth part is "the design of the internet supervision system of Beijing net car charter". This part analyzes the significance of the internet to the government regulation, designs the internet supervision system suitable for the Beijing net car-sharing system, and expounds the operation mechanism of the system The significance of establishing Internet supervision system is analyzed.
