【摘要】：法治建設(shè)的核心是以法律制度有效規(guī)范公權(quán)力的行使和運用,保障公民的合法利益和社會的安定有序,而促使行政機(jī)關(guān)依法行政、保證公民的有序參與作為規(guī)制日益膨脹的行政權(quán)力的重要方向,對我國法治建設(shè)有著不可忽視的重要性。改革開放以來,隨著我國經(jīng)濟(jì)的平穩(wěn)快速發(fā)展,社會環(huán)境的總體穩(wěn)定和廣大人民群眾生活水平的不斷提高,為民眾進(jìn)一步參與政治生活,參與行政機(jī)關(guān)的決策提供極為有力的條件。為此,對行政機(jī)關(guān)的決策水平和質(zhì)量提出了更高的要求,重大行政決策聽證制度也應(yīng)運而生。為避免行政機(jī)關(guān)在重大決策中的失誤和違法,提高決策的科學(xué)性、民主性,建立健全具有我國特色的重大行政決策聽證制度是必要的,也是現(xiàn)實的。處于這種考慮,本文試圖從研究重大行政決策聽證制度的內(nèi)涵和發(fā)展角度,以我國目前重大行政決策聽證的現(xiàn)實情況和存在問題為主線,提出了在我國法治建設(shè)背景下如何完善重大行政決策聽證制度的幾點對策。
[Abstract]:The core of the construction of the rule of law is to regulate the exercise and application of public power effectively with the legal system, to ensure the lawful interests of citizens and the stability and order of the society, and to urge the administrative organs to administer according to law. Ensuring the orderly participation of citizens as an important direction of regulating the expanding administrative power is of great importance to the construction of the rule of law in our country. Since the reform and opening up, with the steady and rapid development of our economy, The overall stability of the social environment and the continuous improvement of the living standards of the broad masses of the people provide extremely powerful conditions for the further participation of the people in political life and in the decision-making of administrative organs. Higher demands have been put forward on the level and quality of decision-making of administrative organs, and the hearing system of major administrative decisions has also come into being. In order to avoid mistakes and violations in major decisions of administrative organs, and to improve the scientific and democratic nature of decision-making, It is necessary and realistic to establish and perfect the hearing system of the major administrative decision with the characteristics of our country. In view of this consideration, this paper attempts to study the connotation and development of the hearing system of the major administrative decision. Based on the actual situation and existing problems of the major administrative decision hearing in our country at present, this paper puts forward some countermeasures on how to perfect the hearing system of the important administrative decision under the background of the rule of law construction in our country.
