【摘要】：我國(guó)營(yíng)業(yè)稅改征增值稅(以下簡(jiǎn)稱(chēng)"營(yíng)改增")試點(diǎn)改革如火如荼,根據(jù)中央三步走規(guī)劃,目前第一、二階段已接近尾聲,第三階段試點(diǎn)工作已經(jīng)逐步全面推開(kāi)。在試點(diǎn)工作取得階段性成果的同時(shí),在改革過(guò)程中也暴露了一些法律問(wèn)題亟待解決。文章試圖以此次改革為背景,著重從分權(quán)的視角,闡述我國(guó)央地財(cái)稅分權(quán)制度的源流及現(xiàn)狀,就當(dāng)前"營(yíng)改增"中較少被關(guān)注的法律層面的問(wèn)題進(jìn)行剖析,結(jié)合部分各地方改革實(shí)踐,就"營(yíng)改增"過(guò)程中的法律治理進(jìn)行展望,并提出相關(guān)意見(jiàn)及建議。
[Abstract]:According to the three-step plan of the central government, the first and second stages are coming to an end, and the third stage of the pilot work has been pushed forward in an all-round way. At the same time, in the process of reform, some legal problems need to be solved. Based on this reform, this article attempts to expound the origin and current situation of the fiscal and taxation decentralization system in central and local areas of our country from the perspective of decentralization, and analyze the legal aspects of the current "management reform and increase", which are less concerned about. Combined with some local reform practices, this paper looks forward to the legal governance in the process of "business reform and increase", and puts forward some relevant opinions and suggestions.
