【摘要】：隨著政府采購招投標制度的不斷推廣及普及，越來越多的供應商相互串通以不正當競爭手段謀取標的，政府采購圍標問題層出不窮，對我國政府采購制度的良性運轉產生了不利影響,不僅造成公共財政資金的浪費，還不利于良好政府形象的塑造。政府作為公共利益的維護者，有責任對政府采購圍標行為進行規(guī)制。對政府采購圍標問題進行梳理，是政府采購科學發(fā)展的必然要求，也是協(xié)調政府與市場關系的應有之義，具有重要現(xiàn)實意義。 本文從政府采購圍標的內涵、特點及危害出發(fā)，結合政府規(guī)制理論中的公共利益理論、部門利益理論及激勵性規(guī)制理論，對我國政府采購圍標問題進行系統(tǒng)分析，深入剖析政府采購圍標問題與政府規(guī)制理論之間的內在邏輯，為政府采購圍標問題的成因分析及規(guī)制對策提供理論依據(jù)。借助典型個案對政府采購圍標行為的三種主要表現(xiàn)形式進行歸納，以期從市場信息不對稱、企業(yè)誠信觀念淡薄、執(zhí)法人員行政倫理失范、政府采購招投標法律體系不健全、規(guī)制機構執(zhí)法力度不足等方面來探析背后成因。并在此基礎上，借鑒美國、日本和韓國著有成效規(guī)制政府采購圍標問題的經(jīng)驗，結合合法合理原則、公開公平原則、誠實信用原則、公眾利益與企業(yè)利益相均衡的原則，探究規(guī)制政府采購圍標問題的對策建議，，從建立規(guī)范化的行業(yè)自律機制、打造高效的規(guī)制主體、健全政府采購招投標立法體系、營造良好的規(guī)制環(huán)境四個方面來探索切實可行的不愿圍標、不能圍標、不敢圍標的一系列規(guī)制對策。
[Abstract]:With the continuous promotion and popularization of the bidding system of government procurement, more and more suppliers collude with each other to obtain the target by unfair competitive means. It not only causes the waste of public finance funds, but also unfavorable to the shaping of good government image. The government, as the defender of public interest, has the responsibility to regulate the bidding behavior of government procurement. It is an inevitable requirement for the scientific development of government procurement to sort out the problem of government procurement. It is also the necessary meaning of coordinating the relationship between the government and the market, which is of great practical significance. Based on the connotation, characteristics and harm of the government procurement standard, this paper systematically analyzes the problem of the government procurement standard in our country by combining the theory of public interest, the theory of department interest and the theory of incentive regulation in the theory of government regulation. In order to provide theoretical basis for the cause analysis and regulation countermeasures of government procurement, this paper deeply analyzes the internal logic between the issue of government procurement bidding and the theory of government regulation. With the help of typical cases, this paper sums up the three main forms of government procurement bidding behavior, in order to improve the legal system of government procurement bidding, such as asymmetric market information, weak concept of enterprise honesty, administrative ethics of law enforcement personnel, and imperfect legal system of bidding for government procurement. The law enforcement of regulatory agencies is not enough to analyze the causes behind it. On this basis, using the experience of the United States, Japan and Korea for reference, combining the principles of legality and reasonableness, openness and fairness, honesty and credit, and balancing public interest with the interests of enterprises, the United States, Japan and South Korea have successfully regulated the issue of government procurement encirclement. This paper probes into the countermeasures and suggestions for the regulation of the surrounding bid of government procurement, from the establishment of a standardized industry self-discipline mechanism, the creation of an efficient regulatory body, and the improvement of the legislative system of government procurement bidding and bidding. Create a good regulatory environment to explore the four aspects of the feasibility of not willing to surround the standard, can not be enclosed, dare not surround a series of regulatory countermeasures.
