【摘要】：公共采購(gòu)合同管理是公共采購(gòu)的重要組成部分,但中國(guó)有關(guān)法律沒(méi)有規(guī)定完整的合同管理制度。雖有一些合同備案和違法或不誠(chéng)信行為記錄公告等要求,但總體上看中國(guó)公共采購(gòu)法的合同管理制度存在突出問(wèn)題,比如在監(jiān)管責(zé)任方面,采購(gòu)人內(nèi)部管理和外部行政監(jiān)督法定責(zé)任的共同缺失;在管理內(nèi)容方面,合同變更、終止和分包等制度缺乏可操作性;在管理手段方面,含混的合同備案和僅僅注重結(jié)果的誠(chéng)信信息管理不能滿足公共采購(gòu)的需要;在管理人員方面,非專業(yè)化的管理隊(duì)伍無(wú)法適應(yīng)合同管理的需要;在合同爭(zhēng)議解決方面,缺乏合同爭(zhēng)議解決的行政處理制度。而美國(guó)政府采購(gòu)有關(guān)制度相對(duì)完善,對(duì)中國(guó)有重要的借鑒意義。筆者在借鑒美國(guó)《聯(lián)邦采購(gòu)條例》的基礎(chǔ)上,指出中國(guó)公共采購(gòu)法應(yīng)當(dāng)樹(shù)立公共采購(gòu)合同必須管理的理念,建立以合同官制度為核心的采購(gòu)人內(nèi)部管控體系并法律化,在完善合同管理制度過(guò)程中要堅(jiān)持權(quán)力法定和平等協(xié)商的融合。
[Abstract]:The contract management of public procurement is an important part of public procurement, but the relevant laws of China do not provide for a complete contract management system.Although there are some requirements for filing contracts and announcing illegal or dishonest acts, there are outstanding problems in the contract management system of China's public procurement law, for example, in terms of regulatory responsibility.Lack of common legal responsibility for internal management and external administrative supervision of the purchaser; lack of maneuverability of systems such as contract change, termination and subcontracting in terms of management content;Vague contract filing and results-based integrity information management could not meet the needs of public procurement; in the case of managers, non-specialized management teams could not meet the needs of contract management; and in the area of contract dispute resolution,Lack of contract dispute resolution administrative system.American government procurement system is relatively perfect, which is of great significance to China.On the basis of drawing lessons from the United States Federal Procurement regulations, the author points out that China's public procurement law should set up the concept that public procurement contracts must be managed, and establish and legalize the internal control system of purchasers with the contract official system as the core.In the process of perfecting the contract management system, we should adhere to the integration of power law and equal consultation.
