【摘要】：現(xiàn)代組織三大權(quán)力要素是由用人權(quán)、財(cái)政權(quán)與治事權(quán)構(gòu)成,而財(cái)政權(quán)日益成為現(xiàn)代國(guó)家治理的基礎(chǔ)。財(cái)政權(quán)在當(dāng)代中國(guó)國(guó)家治理中發(fā)揮建構(gòu)現(xiàn)代國(guó)家治理的形象、成為當(dāng)代中國(guó)現(xiàn)代國(guó)家制度建設(shè)的有效突破口以及形成中國(guó)國(guó)家治理的權(quán)力三分與監(jiān)督新范式等作用。當(dāng)代中國(guó)財(cái)政權(quán)改革的總體部署可以用"一個(gè)總綱、一個(gè)方案、一個(gè)指導(dǎo)意見(jiàn)"來(lái)概括,其主線是圍繞建立既相互制約又相互協(xié)調(diào)的財(cái)政權(quán)而展開(kāi)的,其控權(quán)機(jī)制改革實(shí)踐以控制"三公"經(jīng)費(fèi)支出為先導(dǎo),構(gòu)建公開(kāi)透明機(jī)制、監(jiān)督約束機(jī)制、權(quán)責(zé)對(duì)等機(jī)制、立法保障機(jī)制等。當(dāng)代中國(guó)財(cái)政權(quán)控權(quán)機(jī)制設(shè)計(jì)的戰(zhàn)略安排的核心是理順執(zhí)政黨、人民代表大會(huì)與政府三者的關(guān)系,即發(fā)揮政黨的"方向性作用"、人大的"審查性作用"、政府的"績(jī)效性作用"的"三位一體"作用。在控權(quán)機(jī)制設(shè)計(jì)的路徑選擇方面,走制度化統(tǒng)率漸進(jìn)化、分層化與立體化的改革路徑,開(kāi)創(chuàng)通過(guò)控制財(cái)政權(quán)來(lái)帶動(dòng)整體性權(quán)力制約的中國(guó)式權(quán)力制約新路。
[Abstract]:The three power elements of modern organization are composed of human rights, fiscal rights and administrative powers, and fiscal rights are increasingly becoming the basis of modern state governance, which plays an important role in the construction of modern national governance in contemporary China. To become an effective breakthrough in the construction of the modern state system in contemporary China and to form a new paradigm of governance and supervision in China. The overall plan for the reform of fiscal power in contemporary China can be used as "one general outline, one plan," A guiding opinion is to sum up, its main line is around the establishment of mutual restriction and mutual coordination of the fiscal right, its power control mechanism reform practice to control the "three public" expenditure as the guide, to build an open and transparent mechanism, Supervision and restraint mechanism, power and responsibility equivalence mechanism, legislative guarantee mechanism, etc. The core of the strategic arrangement of the financial power control mechanism in contemporary China is to straighten out the relations among the ruling party, the people's Congress and the government. That is, giving play to the "directional role" of the political party, the "reviewing role" of the people's Congress, and the "trinity" role of the government's "performance function". Stratification and three-dimensional reform path to create a new path of Chinese power restriction by controlling fiscal power to drive the overall power constraints.
