【摘要】：建筑業(yè)是我國(guó)國(guó)民經(jīng)濟(jì)的支柱產(chǎn)業(yè)，它推動(dòng)了整個(gè)社會(huì)和國(guó)民經(jīng)濟(jì)的發(fā)展。但是改革開放三十多年以來，我國(guó)的經(jīng)濟(jì)體制發(fā)生了很大的變化，建設(shè)市場(chǎng)運(yùn)行機(jī)制不成熟，大量農(nóng)民工涌向城市，而且大部分都進(jìn)入了建設(shè)市場(chǎng)，種種原因?qū)е铝私ㄔO(shè)領(lǐng)域中工程款支付中的拖欠問題，而且已經(jīng)成為建設(shè)領(lǐng)域的難題。工程款的拖欠嚴(yán)重危及了工程的質(zhì)量安全，使建筑市場(chǎng)上出現(xiàn)很多“爛尾工程”、“胡子工程”，嚴(yán)重影響了建筑業(yè)的健康發(fā)展，工人工資的大量拖欠也導(dǎo)致出現(xiàn)了很多社會(huì)事件，動(dòng)搖了社會(huì)的正常發(fā)展和穩(wěn)定，扭曲了社會(huì)的信用，阻礙了社會(huì)主義法治建設(shè)和廉政建設(shè)的步伐，嚴(yán)重破壞了市場(chǎng)正常的交易秩序和社會(huì)的經(jīng)濟(jì)秩序。因此，工程款支付中拖欠問題的解決對(duì)策必須提到各有關(guān)部門的日程上來。 本文對(duì)建設(shè)領(lǐng)域工程款支付中的拖欠問題進(jìn)行了分析，對(duì)工程款和工程款拖欠的相關(guān)概念進(jìn)行了界定，并對(duì)工程款支付中拖欠問題的特點(diǎn)、原因及危害等進(jìn)行了分析，在信息不對(duì)稱、委托代理、博弈、重復(fù)博弈等理論的基礎(chǔ)上，對(duì)工程款支付的相關(guān)主體行為進(jìn)行了博弈，通過各博弈本質(zhì)分析抽象出一個(gè)雙方博弈模型，再根據(jù)不同的情況進(jìn)行了具體的分析，并得出了相應(yīng)的博弈結(jié)論，最終提出了工程款支付中拖欠問題的相關(guān)解決機(jī)制和解決對(duì)策，懲戒機(jī)制、信號(hào)傳遞機(jī)制、強(qiáng)制實(shí)行業(yè)主支付擔(dān)保機(jī)制、工人工資實(shí)名發(fā)放等機(jī)制，政府強(qiáng)化監(jiān)控，完善市場(chǎng)的準(zhǔn)入機(jī)制、各有關(guān)部門要切實(shí)履行職責(zé)，加強(qiáng)協(xié)調(diào)監(jiān)督、政府制定保護(hù)工人權(quán)益的法律法規(guī)等措施，希望為解決工程款支付中的拖欠問題提供理論支持和政策建議。本論文的研究有助于規(guī)范建設(shè)領(lǐng)域的經(jīng)濟(jì)秩序和維護(hù)人民群眾的根本利益，對(duì)建筑業(yè)和國(guó)民經(jīng)濟(jì)的健康發(fā)展、社會(huì)穩(wěn)定的維持都有很重要的促進(jìn)作用。 本文主要包括以下六個(gè)部分的內(nèi)容，第一部分是緒論部分，提出選題的背景、目的及意義，并對(duì)國(guó)內(nèi)外相關(guān)研究現(xiàn)狀做了簡(jiǎn)單介紹；第二部分是相關(guān)理論基礎(chǔ)部分，，主要包括委托代理理論、博弈論、重復(fù)博弈理論等理論知識(shí)的介紹；第三部分對(duì)工程款支付中的拖欠問題進(jìn)行了分析，對(duì)工程款拖欠的概念、特點(diǎn)、原因及危害進(jìn)行分析，為后面問題的解決奠定基礎(chǔ)；第四部分是對(duì)工程款支付相關(guān)主體的行為進(jìn)行博弈，并得出相應(yīng)的博弈結(jié)論，為下一部分的解決措施打下基礎(chǔ)；第五部分是在上述幾個(gè)部分的基礎(chǔ)上提出相關(guān)解決機(jī)制、解決對(duì)策，并提出了相關(guān)的建議；第六部分是對(duì)本文的總結(jié)，在上述幾個(gè)章節(jié)的基礎(chǔ)上得出了結(jié)論，并提出了本文的不足和展望。
[Abstract]:Construction industry is the pillar industry of our national economy, it promotes the development of the whole society and national economy. But since the reform and opening up more than 30 years ago, great changes have taken place in the economic system of our country. The operating mechanism of the construction market is not mature. A large number of migrant workers are flocking to the cities, and most of them have entered the construction market. Various reasons lead to the problem of arrears in construction payment, and it has become a difficult problem in construction field. The delay in the payment of the project seriously endangers the quality and safety of the project, causing many "rotten tail projects" and "beard projects" in the construction market, which seriously affect the healthy development of the construction industry. The large amount of arrears in wages of workers has also led to many social events, which have shaken the normal development and stability of society, distorted the credibility of society, and hindered the pace of building the socialist rule of law and building a clean and honest government. Seriously damaged the market normal trading order and social economic order. Therefore, the solution to the problem of arrears in payment must be put on the agenda of the relevant departments. This paper analyzes the problem of arrears in the payment of engineering funds in the field of construction, defines the related concepts of payment of engineering money and arrears of engineering payments, and analyzes the characteristics, causes and hazards of the problems of arrears in payment of engineering funds. Based on the theories of asymmetric information, principal-agent, game and repeated game, this paper makes a game on the behavior of the subject concerned in the payment of engineering funds, and abstracts a game model by analyzing the essence of each game. Then according to the different circumstances of the specific analysis, and draw the corresponding conclusions of the game, and finally put forward the payment of the project in arrears related mechanisms and solutions, disciplinary mechanisms, signal transmission mechanism, The government should strengthen monitoring and improve the market access mechanism. All relevant departments should conscientiously perform their duties and strengthen coordination and supervision. The government formulates laws and regulations to protect workers' rights and interests, hoping to provide theoretical support and policy advice for solving the problem of arrears in payment of engineering funds. The research in this paper is helpful to standardize the economic order in the field of construction and to safeguard the fundamental interests of the people. It also plays an important role in promoting the healthy development of the construction industry and the national economy and the maintenance of social stability. This article mainly includes the following six parts content, the first part is the introduction part, proposes the background, the purpose and the significance of the topic, and has made the brief introduction to the domestic and foreign related research present situation; The second part is the related theoretical basis part, mainly including principal-agent theory, game theory, repeated game theory and other theoretical knowledge of the introduction; The third part has carried on the analysis to the project payment arrears question, has carried on the analysis to the engineering payment arrears concept, the characteristic, the reason and the harm, has laid the foundation for the later problem solution; The fourth part is the behavior of the project payment related to the game, and draw the corresponding conclusions of the game, for the next part of the solution to lay the foundation; The fifth part is on the basis of the above several parts to put forward the relevant solution mechanism, the solution countermeasure, and has proposed the related proposal; The sixth part is the summary of this paper, on the basis of the above several chapters to draw conclusions, and put forward the shortcomings and prospects of this paper.
