【摘要】：食品安全是人類生存和發(fā)展的基礎,它關系到每個食品消費者的切身利益、國家的安全和社會的穩(wěn)定。黨中央、國務院提出的以人為本,構建和諧社會的目標充分表明了要關注民生問題,而食品安全則是最直接涉及民生問題的核心內(nèi)容。 本文經(jīng)過對國內(nèi)食品監(jiān)管的現(xiàn)狀分析得出,我國的食品安全監(jiān)管模式屬于多部門聯(lián)合監(jiān)管的模式,將監(jiān)管環(huán)節(jié)劃分成段進行監(jiān)管。多部門監(jiān)管的特點是將監(jiān)管權力平等的分配給多個監(jiān)管機構,均衡的權利可以達到在監(jiān)管機構中相互制衡的效果,從而提高監(jiān)管效率。而我國多部門監(jiān)管模式中采取的分段監(jiān)管,分段監(jiān)管在監(jiān)管的執(zhí)行時在監(jiān)管環(huán)節(jié)中極易出現(xiàn)銜接縫隙,導致監(jiān)管失靈。從我國的現(xiàn)階段的食品監(jiān)管現(xiàn)狀來看,不難發(fā)現(xiàn)監(jiān)管機構權責劃分不清,職能定位不明；市場自我監(jiān)督意識不足以達到食品安全監(jiān)管的目標；社會力量沒有承擔監(jiān)管的責任；法律監(jiān)管中違法成本不足以對違法企業(yè)起到震懾作用,而這些弊端導致我國現(xiàn)如今在食品監(jiān)管領域仍沒有形成一套完整有效的監(jiān)管模式。所以,本文通過網(wǎng)絡化模式的研究,針對分析以上幾點問題,并借鑒國外在食品監(jiān)管領域的經(jīng)驗,例如：美國和加拿大施行的食品監(jiān)管模式在經(jīng)過幾年的改進中已經(jīng)形成了一套相對完整的監(jiān)管網(wǎng)絡,通過借鑒他們的經(jīng)驗提出適合我國國情的食品監(jiān)管模式,對監(jiān)管存在的問題提出有效地解決意見。 文章所采取的理論支撐便是結合公共管理理論中的網(wǎng)絡化治理理論,在公共管理的領域內(nèi),研究如何整合政府資源、市場資源以及社會資源,試圖建立食品安全的監(jiān)管網(wǎng)絡。通過借鑒網(wǎng)絡化治理的管理模式,將政府和非政府組織編織成一個整體的治理網(wǎng)絡,兼顧效率和公平的原則,充分發(fā)揮各監(jiān)管主體的監(jiān)管能力和協(xié)調(diào)能力,提高食品監(jiān)管的效率。網(wǎng)絡化監(jiān)管模式的建立不僅可以為食品安全問題提供新的解決途徑,而且還為各方參與主體加強食品安全治理效率提供了制度參考。
[Abstract]:Food safety is the basis of human survival and development. It relates to the vital interests of every food consumer, national security and social stability. The goal of the CPC Central Committee and the State Council to build a harmonious society fully shows that we should pay close attention to people's livelihood issues, and food safety is the core content of the people's livelihood issues. Through the analysis of the current situation of food supervision in China, it is concluded that the mode of food safety supervision in our country belongs to the mode of multi-department joint supervision, and the supervision link is divided into sections for supervision. The characteristic of multi-sector supervision is that the power of supervision is equally distributed to many regulatory bodies, and the balanced rights can achieve the effect of checks and balances in the regulatory bodies, thus improving the efficiency of supervision. In our multi-sector supervision mode, the piecewise supervision is easy to appear in the supervision link, which leads to the supervision failure. Judging from the current situation of food supervision in China, it is not difficult to find that the authority and responsibility of the regulatory body are not clearly divided, the function is not clear, the market self-supervision consciousness is not enough to achieve the goal of food safety supervision, and the social forces do not bear the responsibility of supervision. The illegal cost in the legal supervision is not enough to deter the illegal enterprises, but these malpractices lead to the lack of a complete and effective regulatory model in the field of food supervision. Therefore, through the research of network mode, this paper analyzes the above problems, and draws lessons from the experience of foreign countries in the field of food supervision. For example, the food regulatory model implemented in the United States and Canada has formed a relatively complete regulatory network after several years of improvement. Put forward effective solutions to the problems existing in supervision. The theoretical support adopted in this paper is to study how to integrate government resources, market resources and social resources in the field of public management by combining the theory of networked governance in the theory of public management, and try to establish a regulatory network for food safety. By drawing lessons from the management mode of networked governance, the government and non-governmental organizations are woven into an overall governance network, which takes into account the principles of efficiency and fairness, and gives full play to the supervisory and coordination capabilities of all supervisory bodies. Improve the efficiency of food regulation. The establishment of network supervision model can not only provide a new way to solve food safety problems, but also provide institutional reference for the participants to strengthen the efficiency of food safety governance.
