【摘要】：[目的/意義]專利引用是專利價(jià)值評(píng)價(jià)的指標(biāo)之一,深入分析施引專利與原專利之間的關(guān)系,可以有效地評(píng)判專利引用指標(biāo)在專利價(jià)值評(píng)價(jià)中的效力。[方法/過程]首先,選取獲得中國(guó)專利獎(jiǎng),且在美國(guó)提交申請(qǐng)的專利,再檢索獲獎(jiǎng)專利的施引專利,通過對(duì)比施引專利與獲獎(jiǎng)專利的摘要和權(quán)利要求等,可將施引專利分為差異技術(shù)、關(guān)聯(lián)技術(shù)、同類技術(shù)和近似技術(shù)4類。其次,對(duì)這4類施引專利做統(tǒng)計(jì)上的比較以及檢驗(yàn)。[結(jié)論/結(jié)果]研究表明,專利引用可以有效作為專利價(jià)值的評(píng)價(jià)指標(biāo),且專利引用可作為遴選專利的指標(biāo)。不同施引專利的類型在專利價(jià)值評(píng)價(jià)中的效力不同,只有將施引專利進(jìn)行分類處理,才能更好地將專利引用指標(biāo)應(yīng)用于專利價(jià)值評(píng)價(jià)。
[Abstract]:[purpose / significance] Patent citation is one of the indexes of patent value evaluation. Analyzing the relationship between patent citation and original patent can effectively evaluate the effectiveness of patent citation index in patent value evaluation. [method / process] first of all, The patent awarded by China and applied for in the United States is selected, then the patent awarded is searched. By comparing the abstract and claim of patent, the patent can be divided into differential technology, related technology, and so on. Secondly, the statistical comparison and test of the four categories of patent citation are made. [conclusions / results] study shows that patent citation can be used as an effective evaluation index of patent value. Patent citation can be used as the index of patent selection. The effectiveness of different patent types in patent value evaluation is different. Only by classifying patent citation can patent citation index be better applied to patent value evaluation.
