【摘要】：在經(jīng)濟(jì)全球化的背景下,資本在全球范圍內(nèi)迅速流動(dòng),經(jīng)濟(jì)一體化需要各國(guó)采取統(tǒng)一的法律監(jiān)管制度,然而當(dāng)下差異化的監(jiān)管制度使金融經(jīng)營(yíng)者產(chǎn)生了不同的收益。金融經(jīng)營(yíng)者可以利用其信息優(yōu)勢(shì),在不同的制度中轉(zhuǎn)換經(jīng)營(yíng)行為,獲得經(jīng)營(yíng)收益,從而形成監(jiān)管套利。監(jiān)管套利產(chǎn)生的"監(jiān)管競(jìng)次"和"監(jiān)管寬容"最終造成世界范圍內(nèi)金融風(fēng)險(xiǎn)。同時(shí),監(jiān)管套利在法律上也是不正當(dāng)?shù)�。因�?需要積極探索后危機(jī)時(shí)代關(guān)于監(jiān)管套利法律創(chuàng)新的新思維,采取統(tǒng)一法律監(jiān)管標(biāo)準(zhǔn)、完善信息獲取方式、加強(qiáng)信息共享等多種方式規(guī)制國(guó)際監(jiān)管套利。
[Abstract]:Under the background of economic globalization, capital flows rapidly all over the world. Economic integration requires uniform legal supervision system from different countries. However, the differentiated regulation system has brought different benefits to financial operators. Financial operators can make use of their information advantages to convert operation behavior in different systems and gain operating profits, thus forming regulatory arbitrage. The "regulatory race" and "regulatory tolerance" resulting from regulatory arbitrage ultimately lead to financial risks worldwide. At the same time, the regulatory arbitrage is not legally justified. Therefore, we need to actively explore the new thinking of legal innovation of regulatory arbitrage in the post crisis era, and adopt various ways to regulate international regulatory arbitrage, such as unified legal supervision standards, improving information acquisition mode and strengthening information sharing.
