論建筑作品著作權(quán)侵權(quán)的認(rèn)定

【摘要】:建筑被喻為凝固的音樂,而音樂被喻為流動(dòng)的建筑。隨著建筑業(yè)的發(fā)展,建筑作品的保護(hù)不僅是眾多業(yè)內(nèi)人士關(guān)注的焦點(diǎn),而且亦關(guān)系到我們廣大業(yè)主的切身利益。盡管我國將建筑作品單列為著作權(quán)法保護(hù)的一類客體,但規(guī)定仍較為粗糙,可操作性不強(qiáng),因此對(duì)其相關(guān)理論與法律實(shí)踐還有許多需要深入研究的地方。本文從建筑作品著作權(quán)的相關(guān)理論出發(fā),重點(diǎn)對(duì)幾種主要的建筑作品侵權(quán)行為的認(rèn)定進(jìn)行討論: 第一部分,建筑作品的基本理論。首先對(duì)建筑作品的概念進(jìn)行梳理,并將其分別與建筑物、美術(shù)作品進(jìn)行辨析。其次,在參照國際上對(duì)建筑作品保護(hù)范疇的相關(guān)規(guī)定,并比較了建筑作品的各種表現(xiàn)形式間的關(guān)聯(lián)之后,將建筑作品保護(hù)的范圍確定為建筑物、建筑設(shè)計(jì)圖與建筑模型。最后,對(duì)建筑作品的權(quán)利主體進(jìn)行分析,并明確了保護(hù)建筑作品著作權(quán)的意義。 第二部分,建筑作品侵權(quán)行為的表現(xiàn)、特征、分類及構(gòu)成要件。首先引用幾則案例說明當(dāng)下建筑作品侵權(quán)行為的表現(xiàn)形式多樣化、復(fù)雜化;其次結(jié)合著作權(quán)法的基本原理,對(duì)建筑作品侵權(quán)行為的特征與分類進(jìn)行討論;明確侵權(quán)行為的構(gòu)成要件:即未經(jīng)許可實(shí)施了受建筑作品專有權(quán)控制的行為且沒有法定的免責(zé)事由。 第三部分,建筑作品侵權(quán)行為的具體認(rèn)定。首先討論了建筑作品的獨(dú)創(chuàng)性判斷,這是認(rèn)定侵權(quán)不可或缺的一環(huán),其判斷結(jié)果直接影響著建筑作品侵權(quán)行為的認(rèn)定。然后針對(duì)主要的侵犯建筑作品專有權(quán)的行為予以分別論述:復(fù)制是對(duì)建筑作品侵權(quán)的主要方式,復(fù)制的方式應(yīng)該包括立體與平面之間的復(fù)制,同時(shí)對(duì)復(fù)制、剽竊、抄襲、臨摹進(jìn)行了辨別,這些都是認(rèn)定復(fù)制侵權(quán)必須要解決的問題;侵犯發(fā)行權(quán)的行為主要表現(xiàn)在宣傳手段上,對(duì)其的認(rèn)定主要取決于發(fā)行目的與權(quán)利人許可;而侵犯展覽權(quán)、改編權(quán)以及一些人身權(quán)行為的認(rèn)定也各有其特殊之處,但是無論多么復(fù)雜的侵權(quán)行為,都是以侵權(quán)行為的構(gòu)成為基礎(chǔ)進(jìn)行認(rèn)定的。
[Abstract]:Architecture is described as solidified music, and music is described as flowing architecture. With the development of construction industry, the protection of architectural works is not only the focus of attention, but also related to the immediate interests of our owners. Although the construction works are listed as a kind of object protected by copyright law in our country, the regulations are still relatively rough and the operability is not strong. Therefore, there are still many aspects that need to be deeply studied in the relevant theory and legal practice. Based on the theory of the copyright of architectural works, this paper focuses on the identification of several major infringing acts of architectural works. The first part is the basic theory of architectural works. First of all, the concept of architectural works is combed, and it is distinguished from buildings and art works. Secondly, the scope of protection of architectural works is defined as buildings, architectural design drawings and architectural models after comparing the relationships between various forms of expression of architectural works, referring to the relevant provisions of the international protection category of architectural works. Finally, the author analyzes the subject of the right of architectural works, and clarifies the significance of protecting the copyright of architectural works. The second part, the expression, the characteristic, the classification and the constituent elements of the tort of the architectural works. Firstly, several cases are cited to illustrate the diversity and complexity of the current tort of architectural works; secondly, the characteristics and classification of the infringing acts of architectural works are discussed in combination with the basic principles of copyright law. It is clear that the constitution of the tort is that the act controlled by the exclusive right of the building work has been carried out without permission and there is no statutory exemption. The third part, the concrete confirmation of the tort of construction works. Firstly, the author discusses the originality judgment of architectural works, which is an indispensable link in the determination of tort, and the result of judgment directly affects the identification of infringing acts of architectural works. Then the main acts of infringing the exclusive rights of architectural works are discussed separately: reproduction is the main way of infringing architectural works, the way of reproduction should include the reproduction between three-dimensional and plane, at the same time, copying, plagiarism, plagiarism, plagiarism, plagiarism, plagiarism, and plagiarism. Copy has been identified, these are the problems that must be solved in the determination of copyright infringement; the act of infringing the right of distribution is mainly manifested in the means of publicity, and the identification of the infringement mainly depends on the purpose of the issue and the permission of the right holder; and the infringement of the right of exhibition, The right of adaptation and the recognition of some personal rights have their own special features, but no matter how complex the tort, it is based on the constitution of the tort.
