【摘要】：雖然紅頭文件有被任性濫用的現(xiàn)象,但黨政機(jī)關(guān)以紅頭文件的方式實(shí)施正常的公共管理仍然具有其現(xiàn)實(shí)合理性。紅頭文件本身沒(méi)有原罪,也必然會(huì)繼續(xù)存在下去,錯(cuò)在個(gè)別基層政府機(jī)關(guān)的任性濫用。因此,亟需通過(guò)進(jìn)一步完善立法審查制度、行政立法授權(quán)制度、地方人大立法制度,有效防止紅頭文件濫用,加快推進(jìn)法治國(guó)家和有限政府建設(shè)。
[Abstract]:Although the redhead document is abused willfully, it is still reasonable for the Party and government to carry out the normal public administration by the way of the redhead document. The red-headed document itself does not have original sin, also will certainly continue to exist, the mistake lies in the individual grass-roots government organ willful abuse. Therefore, it is urgent to improve the legislative review system, the administrative legislative authorization system and the local people's Congress legislative system to effectively prevent the abuse of red-headed documents and accelerate the construction of a country ruled by law and limited government.
