城市化進(jìn)程中建設(shè)用地儲備開發(fā)模式研究

【摘要】:土地儲備開發(fā)對于提高土地資源配置效率,增強(qiáng)政府對土地市場的宏觀調(diào)控能力,促進(jìn)城市有計(jì)劃地均衡發(fā)展等都有非常重要的意義。在各地探索實(shí)施土地儲備開發(fā)的過程中,逐漸誕生了許多有代表性的模式和做法,但都存在著如何協(xié)調(diào)政府與市場的關(guān)系,土地收益如何合理分配、土地征用補(bǔ)償不合理等問題。并且城市化進(jìn)程的加快和城市外延式擴(kuò)張與耕地保護(hù)的矛盾日益加深,,改革城鄉(xiāng)二元土地管理體制,推進(jìn)城鄉(xiāng)一體化發(fā)展等新的時(shí)代背景對土地儲備開發(fā)提出了更高的要求。因此,建設(shè)用地儲備開發(fā)模式的研究對于新時(shí)期城鄉(xiāng)統(tǒng)籌發(fā)展、促進(jìn)城市和農(nóng)村建設(shè)用地集約高效利用等方面都具有非常重要的理論價(jià)值和實(shí)踐意義。 土地儲備制度最早在荷蘭、瑞典等歐洲國家實(shí)行,隨后世界上許多國家都開始推行這個(gè)制度,并在大部分國家獲得成功,取得了良好的效果。因此,本文首先借鑒國外土地儲備開發(fā)制度的具體做法,歸納出國外成功實(shí)施土地儲備開發(fā)制度的共同經(jīng)驗(yàn):成立專門的公共管理機(jī)構(gòu);廣泛建立土地銀行;設(shè)置多元化融資渠道;普遍設(shè)立優(yōu)先購買權(quán);注重維護(hù)公共利益;強(qiáng)調(diào)依法儲備。 其次本文總結(jié)出政府主導(dǎo)是目前我國土地儲備開發(fā)模式的顯著特點(diǎn),并對政府主導(dǎo)的優(yōu)缺點(diǎn)進(jìn)行了分析。通過國內(nèi)四種典型土地儲備開發(fā)模式的對比研究,梳理出其各自模式的特點(diǎn)、實(shí)施效果,為各地土地儲備開發(fā)模式的選擇提供參考價(jià)值。 再次針對目前土地儲備開發(fā)模式中出現(xiàn)的問題,本文提出了公私協(xié)議合作開發(fā)的土地儲備開發(fā)方式;拓展多元化融資渠道;土地儲備開發(fā)引入公共參與機(jī)制等措施和建議。同時(shí)運(yùn)用博弈論對土地儲備開發(fā)相關(guān)利益主體進(jìn)行分析,提出完善土地利益分配機(jī)制的措施。 最后為推動城鄉(xiāng)統(tǒng)籌發(fā)展,提出將集體建設(shè)用地納入土地儲備開發(fā)。以建立新的土地征收制度和集體建設(shè)用地流轉(zhuǎn)制度為核心構(gòu)建城鄉(xiāng)一體化的土地市場,從而將土地儲備探索成為城鄉(xiāng)土地交易的新平臺。 本文的創(chuàng)新主要在以下三個(gè)方面: 一是本文通過對國內(nèi)外典型土地儲備開發(fā)模式的對比研究,為各地土地儲備開發(fā)模式的選擇提供參考價(jià)值。 二是對土地儲備開發(fā)相關(guān)利益主體進(jìn)行博弈分析,提出了完善利益分配機(jī)制的措施。同時(shí)在儲備開發(fā)主體優(yōu)化措施中提出了公私協(xié)議合作開發(fā)方式,并設(shè)計(jì)了具體操作流程。 三是構(gòu)建城市一體化的土地市場。本文以建立新的土地征收制度和集體建設(shè)用地入市流轉(zhuǎn)的運(yùn)行機(jī)制為核心,設(shè)計(jì)了城鄉(xiāng)一體化土地市場的框架,從而為城鄉(xiāng)統(tǒng)籌發(fā)展背景下探索我國土地儲備開發(fā)制度變遷路徑提供了新的方向。
[Abstract]:The development of land reserve is of great significance for improving the efficiency of land resources allocation, strengthening the government's ability of macro-control over the land market, and promoting the planned and balanced development of the city. In the process of exploring and implementing the land reserve development in various places, many representative models and practices have gradually emerged, but there is how to coordinate the relationship between the government and the market, and how to distribute the land proceeds reasonably. Land expropriation compensation is unreasonable and so on. With the acceleration of urbanization and the contradiction between urban extension expansion and cultivated land protection, the reform of urban-rural dual land management system and the promotion of urban-rural integration have put forward higher requirements for land reserve development. Therefore, the research on the development mode of construction land reserve is of great theoretical value and practical significance for the development of urban and rural areas and the promotion of intensive and efficient utilization of construction land in urban and rural areas in the new period. The land reserve system was first implemented in the Netherlands, Sweden and other European countries, then many countries in the world began to implement the system, and in most countries, it has achieved good results. Therefore, this paper first draw lessons from the specific practices of foreign land reserve development system, sum up the common experience of successful implementation of land reserve development system abroad: set up special public management institutions, widely establish land bank; Set up diversified financing channels; establish preemptive right generally; pay attention to safeguarding public interest; emphasize legal reserve. Secondly, this paper summarizes that government leading is the remarkable characteristic of land reserve development mode in our country at present, and analyzes the advantages and disadvantages of government leading. Through the comparative study of four typical land reserve development models in China, the characteristics of their respective models and their implementation effects are sorted out, which provides a reference value for the selection of land reserve development models in various parts of the country. Thirdly, in view of the problems in the current land reserve development model, this paper puts forward some measures and suggestions, such as the development of land reserve by public-private agreement, the expansion of diversified financing channels, the introduction of public participation mechanism into land reserve development, and so on. At the same time, the game theory is used to analyze the relevant stakeholders of land reserve development, and the measures to perfect the mechanism of land interest distribution are put forward. Finally, in order to promote the overall development of urban and rural areas, put forward the collective construction land into land reserve development. Taking the establishment of new land expropriation system and collective construction land transfer system as the core to construct the urban-rural integrated land market, the land reserve will be explored as a new platform for urban and rural land transactions. The innovation of this paper is mainly in the following three aspects: The first is to provide reference value for the choice of land reserve development mode in various places through the comparative study of typical land reserve development models at home and abroad. The second is the game analysis of the relevant stakeholders in the development of land reserve, and the measures to improve the mechanism of interest distribution are put forward. At the same time, the author puts forward the public-private agreement cooperative development method in the optimization measures of reserve development subject, and designs the concrete operation flow. Third, the construction of urban integration of the land market. Based on the establishment of new land expropriation system and the operation mechanism of collective construction land circulation, this paper designs the framework of urban-rural integrated land market. Therefore, it provides a new direction for exploring the path of land reserve development system in China under the background of urban and rural overall development.
