工程爭端影響因素及爭端預(yù)防研究

【摘要】:工程項(xiàng)目建設(shè)過程中,工程糾紛基本上是不可避免的,由于人們的立場不同,對于工程爭端的認(rèn)知存在較大的差異,故而容易上升為工程爭端或者工程訴訟。發(fā)生工程爭端后,項(xiàng)目相關(guān)參與方為了應(yīng)對工程爭端,通常會需要花費(fèi)大量的爭端費(fèi)用,而且項(xiàng)目相關(guān)參與方未必能夠贊同工程爭端的裁決結(jié)果,影響了項(xiàng)目的順利實(shí)施和雙方的利益。大量的案例和文獻(xiàn)表明,某些因素對于引發(fā)工程爭端起到極為重要的作用,通過建立工程爭端預(yù)測模型,預(yù)測工程是否會發(fā)生爭端,并針對可能發(fā)生爭端的項(xiàng)目,分析導(dǎo)致工程爭端發(fā)生的主要因素,采取合理有效的管理與控制措施,能夠在一定程度上降低工程爭端發(fā)生的概率和損失。本文搜集和整理工程爭端案例,通過對引起工程爭端的某些主要因素,如業(yè)主和承包商的管理與組織、雙方的關(guān)系價(jià)值、項(xiàng)目的規(guī)模與復(fù)雜性、資金計(jì)劃、合同與風(fēng)險(xiǎn)管理以及項(xiàng)目的范圍定義等,進(jìn)行分析后,將其歸結(jié)為過程、人員以及項(xiàng)目三類因素,并針對能夠引發(fā)工程爭端的要素設(shè)計(jì)相應(yīng)的調(diào)查問卷。利用網(wǎng)絡(luò)和現(xiàn)場發(fā)放的形式收集和整理調(diào)查問卷,并對數(shù)據(jù)進(jìn)行因子分析,提取了9個(gè)因子,據(jù)此建立了工程爭端預(yù)測模型,并通過實(shí)例對工程爭端預(yù)測模型進(jìn)行驗(yàn)證,模型得到較可靠驗(yàn)證。工程爭端潛在指數(shù)的模型能夠幫助工程項(xiàng)目管理人員在工程項(xiàng)目開始階段和隨后的履行合同過程中,認(rèn)識到產(chǎn)生工程爭端的潛在因素,從合同公平和公正的角度,發(fā)現(xiàn)產(chǎn)生爭端的深層次原因,并引導(dǎo)簽約雙方改進(jìn)約定和建立更和諧的關(guān)系,營造良好的工程實(shí)施環(huán)境,達(dá)成雙贏的局面。
[Abstract]:In the course of construction of engineering projects, engineering disputes are basically inevitable. Because of different positions of people, there are great differences in cognition of engineering disputes, so it is easy to rise to engineering disputes or engineering litigation. After a project dispute occurs, the project participants usually need to spend a lot of costs in order to deal with the project dispute, and the project participants may not be able to agree with the outcome of the project dispute decision. Affected the smooth implementation of the project and the interests of both sides. A large number of cases and literature have shown that certain factors play a very important role in the initiation of engineering disputes, by establishing a prediction model for engineering disputes, predicting whether a project will occur disputes, and aiming at projects where disputes may arise, By analyzing the main factors leading to the occurrence of engineering disputes and taking reasonable and effective management and control measures, the probability and loss of the occurrence of engineering disputes can be reduced to a certain extent. This paper collects and collates the cases of engineering disputes, through the management and organization of the owners and contractors, the value of the relationship between the two sides, the scale and complexity of the project, the capital plan, and the management and organization of the owners and contractors. Contract and risk management as well as the definition of project scope are analyzed and summarized into three kinds of factors: process, personnel and project. A questionnaire is designed for the factors that can lead to engineering disputes. The questionnaire is collected and sorted out in the form of network and on-the-spot distribution, and nine factors are extracted from the data by factor analysis. Based on this, a project dispute prediction model is established and verified by an example. The model is proved to be reliable. A model of the potential index of engineering disputes can help project managers recognize the underlying factors that give rise to engineering disputes in the initial phase of the project and the subsequent performance of the contract, from the perspective of fairness and fairness of the contract, Find out the deep causes of the dispute, and guide the two parties to improve the agreement and establish a more harmonious relationship, create a good project implementation environment, and achieve a win-win situation.
