隨著社會經(jīng)濟的不斷發(fā)展,人們越來越重視知識產(chǎn)權(quán),尤其是商標(biāo)權(quán)。在此背景下,2015年歐盟發(fā)布了《歐洲議會和歐盟理事會關(guān)于協(xié)調(diào)成員國商標(biāo)立法的指令》。本次翻譯實踐以這份指令作為翻譯素材,將該指令的英文版本譯為中文版本。該指令作為一種協(xié)調(diào)法,重在協(xié)調(diào)歐盟成員國之間的商標(biāo)實體法和程序法規(guī)則。其內(nèi)容比《保護工業(yè)產(chǎn)權(quán)的巴黎公約》更豐富,操作性更強,對我國協(xié)調(diào)兩岸四地的商標(biāo)法規(guī)則有重要的借鑒意義,對實踐中商標(biāo)爭議的解決也有較高的參考價值。本翻譯實踐以弗米爾的目的論為指導(dǎo),確定了翻譯的目的和使命。本文分析了原文的語體特征,以商標(biāo)法領(lǐng)域的專業(yè)術(shù)語和長難句為重點,列舉了一些翻譯實例,詳細闡述了難點及其解決過程。最后對本次翻譯實踐進行了總結(jié)。
