【摘要】：法治背景下,運(yùn)用法治思維和法治方法推動我國檔案行業(yè)管理體制的改革完善,首先要建立檔案信息的權(quán)利意識。檔案信息不僅是檔案管理客體,也是行業(yè)最基礎(chǔ)的財(cái)產(chǎn)。在法律層面上,檔案信息滿足財(cái)產(chǎn)權(quán)要求的價(jià)值性、稀缺性、可控性條件。我國現(xiàn)行檔案法的相關(guān)規(guī)定,也從物權(quán)、秘密權(quán)、知識產(chǎn)權(quán)等領(lǐng)域給予檔案信息財(cái)產(chǎn)權(quán)。確立檔案信息的財(cái)產(chǎn)地位,對于提高檔案管理體制法治化,理順檔案開發(fā)思路,解決檔案行業(yè)具體問題有著積極意義。
[Abstract]:Under the background of the rule of law, it is necessary to establish the right consciousness of archival information to promote the reform and perfection of the management system of archival industry by using the thinking of rule of law and the method of rule of law. Archival information is not only the object of archives management, but also the most basic property of the industry. On the legal level, archival information meets the value, scarcity and controllability requirements of property rights. The relevant provisions of China's current archives law also give archival information property rights from the fields of real right, secret right, intellectual property and so on. It is of great significance to establish the property status of archival information for improving the legalization of archival management system, straightening out the thinking of archives development and solving the specific problems of archival industry.
