【摘要】：一方面計(jì)算機(jī)信息科技極大地改變了人們的生活，作為知識(shí)產(chǎn)權(quán)法重要部門的專利制度功不可沒，而在另一方面，，專利制度是推動(dòng)還是阻礙了這一領(lǐng)域的創(chuàng)新也引發(fā)了越來(lái)越多的討論。尤其是計(jì)算機(jī)程序相關(guān)領(lǐng)域?qū)＠麉擦终桨l(fā)密集，這使得新興企業(yè)進(jìn)入市場(chǎng)的成本變高，阻礙技術(shù)進(jìn)步和充分競(jìng)爭(zhēng)，而且容易形成傳統(tǒng)巨頭的壟斷，對(duì)企業(yè)來(lái)說(shuō)，大量專利的持有成本也相當(dāng)高昂。隨之產(chǎn)生的大量問(wèn)題專利，增加了無(wú)效訴訟的負(fù)擔(dān)，耗費(fèi)社會(huì)資源，也容易造成專利權(quán)的濫用。 計(jì)算機(jī)程序相關(guān)領(lǐng)域?qū)＠麉擦值某梢�，既有專利法律制度的設(shè)計(jì)落后于時(shí)代的原因，特別是對(duì)傳統(tǒng)領(lǐng)域和新興領(lǐng)域適用同樣的專利制度，使得傳統(tǒng)專利制度下的十八個(gè)月保密期等規(guī)定的反應(yīng)速度跟不上計(jì)算機(jī)程序相關(guān)領(lǐng)域的發(fā)展；同時(shí)也有專利行政機(jī)關(guān)在審查程序上的存在缺陷的因素，其片面追求行政效率，沒有及時(shí)引入法院的制衡和限制專利申請(qǐng)人的擴(kuò)權(quán)傾向。 從微觀角度而言，計(jì)算機(jī)程序相關(guān)領(lǐng)域的企業(yè)應(yīng)對(duì)專利叢林的策略有：考慮通過(guò)研發(fā)或收購(gòu)積極取得專利，以數(shù)量彌補(bǔ)質(zhì)量；合理地撰寫專利申請(qǐng)文件，制定專利戰(zhàn)略使專利價(jià)值最大化；以商業(yè)化為導(dǎo)向，積極尋求實(shí)施專利；同時(shí)，通過(guò)對(duì)核心專利進(jìn)行突破，達(dá)成交叉授權(quán)，以最終踏過(guò)這專利叢林。
[Abstract]:On the one hand, computer information technology has greatly changed people's lives, and the patent system, which is an important part of intellectual property law, can not be ignored. On the other hand, Whether the patent system promotes or impedes innovation in this field has triggered more and more discussion. In particular, the patent jungle is becoming more and more intensive in computer program-related fields, which makes it more expensive for emerging enterprises to enter the market, hinders technological progress and full competition, and easily forms the monopoly of traditional giants. The cost of holding a large number of patents is also quite high. A large number of problem patents, which increase the burden of invalid litigation, consume social resources and lead to abuse of patent rights. The causes of the patent jungle in computer program related fields, the reasons why the patent legal system is behind the times, especially the application of the same patent system to the traditional and emerging fields. So that the traditional patent system under the 18-month secrecy period and other provisions of the response speed can not keep up with the development of computer programs related fields; At the same time, there are some defects in the examination procedure of the patent administrative organ. It pursues the administrative efficiency one-sidedly, and fails to introduce the court in time to check and balance and restrict the patent applicant's expanding power tendency. From the microcosmic point of view, the strategies for enterprises in computer program related fields to deal with the patent jungle are as follows: to actively obtain patents through R & D or acquisition, and to make up for the quality by quantity; Writing patent application documents rationally, making patent strategy to maximize the value of patent; taking commercialization as the guide, actively seeking to implement patent; at the same time, through breakthrough of core patent, reaching cross-authorization, finally stepping over the patent jungle.
