【摘要】：作為一種重要的知識(shí)產(chǎn)權(quán),專利被現(xiàn)代企業(yè)視為生命線。在以創(chuàng)新為引領(lǐng)的移動(dòng)互聯(lián)網(wǎng)時(shí)代,企業(yè)之間的競(jìng)爭(zhēng)愈加激烈,越來(lái)越多的科技公司,選擇法庭作為行業(yè)間較量的第一戰(zhàn)場(chǎng),專利授權(quán)和交易活動(dòng)十分活躍,相關(guān)專利糾紛事件頻發(fā)。隨著技術(shù)的不斷發(fā)展進(jìn)步,移動(dòng)智能終端(Mobile Smart Terminal, MST)企業(yè)各類智能手機(jī)的不斷推出,加劇了企業(yè)間的競(jìng)爭(zhēng),導(dǎo)致專利訴訟事件的頻繁爆發(fā),形成了一場(chǎng)圍繞移動(dòng)智能終端相關(guān)專利展開(kāi)的全球訴訟大戰(zhàn),如何在這場(chǎng)專利大戰(zhàn)中保存實(shí)力并占據(jù)競(jìng)爭(zhēng)優(yōu)勢(shì),成為了各個(gè)企業(yè)關(guān)注的焦點(diǎn)。 作為西方社會(huì)學(xué)的一個(gè)重要分支,社會(huì)網(wǎng)絡(luò)分析法是對(duì)社會(huì)關(guān)系結(jié)構(gòu)及其屬性加以分析的一套規(guī)范和方法,在社會(huì)學(xué)研究中已經(jīng)得到了廣泛的運(yùn)用,為社會(huì)學(xué)的發(fā)展研究做出了突出的貢獻(xiàn)。然而,將社會(huì)網(wǎng)絡(luò)分析方法應(yīng)用到專利訴訟關(guān)系分析的國(guó)內(nèi)外研究相對(duì)較少,特別是針對(duì)移動(dòng)智能終端領(lǐng)域。在社會(huì)網(wǎng)絡(luò)分析方法中,將各企業(yè)看成一個(gè)點(diǎn),企業(yè)間的專利訴訟關(guān)系可構(gòu)成一個(gè)專利訴訟關(guān)系網(wǎng)絡(luò),而UCINET作為一款實(shí)用的社會(huì)網(wǎng)絡(luò)分析工具,可以很好的對(duì)訴訟關(guān)系網(wǎng)絡(luò)進(jìn)行相關(guān)的可視化分析,清楚的看出各企業(yè)間的關(guān)系及訴訟關(guān)系網(wǎng)絡(luò)的整體情況,并在此基礎(chǔ)上得出企業(yè)訴訟行為背后的戰(zhàn)略意圖。 本研究通過(guò)統(tǒng)計(jì)近幾年來(lái)移動(dòng)智能終端領(lǐng)域的專利訴訟事件,采用社會(huì)網(wǎng)絡(luò)分析法,運(yùn)用UCINET社會(huì)網(wǎng)絡(luò)分析工具,對(duì)訴訟關(guān)系網(wǎng)絡(luò)的基本特征進(jìn)行了分析,進(jìn)而對(duì)移動(dòng)智能終端領(lǐng)域的整體訴訟情況有所了解,揭示了該領(lǐng)域內(nèi)各企業(yè)專利訴訟的相互關(guān)系,并對(duì)其訴訟原因進(jìn)行了分析�；谏鲜龇治鼋Y(jié)果,提出了我國(guó)移動(dòng)智能終端企業(yè)在專利戰(zhàn)中專利訴訟戰(zhàn)略的選擇及實(shí)施,以期為各企業(yè)應(yīng)對(duì)專利訴訟及專利糾紛制定策略提供參考和依據(jù)。
[Abstract]:As an important intellectual property right, patent is regarded as lifeline by modern enterprises. In the era of innovation-led mobile Internet, the competition among enterprises is becoming more and more intense. More and more technology companies choose the court as the first battlefield of competition between industries. Patent licensing and trading activities are very active. Related patent disputes occur frequently. With the continuous development and progress of technology, various kinds of smart phones of mobile intelligent terminal (Mobile Smart Terminal, MST) enterprise have been launched continuously, which has intensified the competition among enterprises and led to the frequent outbreak of patent litigation events. A global litigation war has been formed around the patents related to mobile intelligent terminals. How to preserve the power and occupy the competitive advantage in this patent war has become the focus of attention of all enterprises. As an important branch of western sociology, social network analysis is a set of norms and methods to analyze the structure and attributes of social relations, and has been widely used in sociological research. It has made outstanding contributions to the development of sociology. However, there are few researches on the application of social network analysis method to patent litigation relationship analysis at home and abroad, especially in the field of mobile intelligent terminals. In the method of social network analysis, each enterprise is regarded as a point, the patent litigation relationship between enterprises can form a patent litigation relationship network, and UCINET is a practical social network analysis tool. It can make a good visual analysis of the litigation relationship network, clearly see the relationship between the enterprises and the overall situation of the litigation relationship network, and on the basis of this, we can get the strategic intention behind the enterprise litigation behavior. Based on the statistics of patent litigation events in the field of mobile intelligent terminal in recent years, this study analyzes the basic characteristics of litigation relationship network by using social network analysis method and UCINET social network analysis tool. Furthermore, the author has some understanding of the whole litigation situation in the field of mobile intelligent terminal, reveals the relationship between the patent litigation of various enterprises in this field, and analyzes the causes of the litigation. Based on the above analysis results, this paper puts forward the choice and implementation of patent litigation strategy for mobile intelligent terminal enterprises in the patent war, in order to provide reference and basis for enterprises to deal with patent litigation and patent disputes.
