【摘要】：加入Trips協(xié)議以來,我國在知識產(chǎn)權(quán)法中增加了"臨時禁令"的規(guī)定。但在審理商業(yè)秘密案件中,對是否應(yīng)簽發(fā)臨時禁止令、何時簽發(fā)臨時禁止令、簽發(fā)臨時禁止令時申請人需承擔(dān)哪些舉證責(zé)任,法律并無具體規(guī)定,司法審判中也無統(tǒng)一、具體的標(biāo)準(zhǔn)。本文擬從美國判例法出發(fā),重點研究臨時禁止令的簽發(fā)申請人需承擔(dān)的舉證責(zé)任,為我國在商業(yè)秘密案件審理過程中對于臨時禁止令救濟(jì)措施的運(yùn)用提供有益借鑒,同時為我國反不正當(dāng)競爭法的修訂提供參考。
[Abstract]:After joining the Trips agreement, our country has added the "temporary injunction" in the intellectual property law. However, in the trial of trade secrets cases, there are no specific provisions in the law as to whether or not an interim prohibition order should be issued, when an interim prohibition order is issued, and what the burden of proof is to be borne by the applicant when issuing an interim prohibition order. Specific criteria. Starting from the case law of the United States, this paper focuses on the burden of proof to be borne by the applicant for the issuance of a temporary injunction, which provides a useful reference for the application of relief measures of the interim injunction in the course of the trial of trade secrets cases in our country. At the same time for our country anti-unfair competition law revision provides the reference.
