【摘要】：隨著知識(shí)產(chǎn)權(quán)不斷的發(fā)展,商標(biāo)權(quán)利逐漸被人們所重視,人們的維權(quán)意識(shí)也不斷增強(qiáng)。馳名商標(biāo)因其是品質(zhì)和口碑的保證,法律給予馳名商標(biāo)比普通商標(biāo)更高的保護(hù),但是只賦予權(quán)利沒有限制就會(huì)出現(xiàn)問題,導(dǎo)致馳名商標(biāo)權(quán)人濫用其商標(biāo)權(quán)利,損害其他商標(biāo)權(quán)人的利益。而我國法律在馳名商標(biāo)認(rèn)定和權(quán)利行使限制方面還存在很多不足,這也是導(dǎo)致馳名商標(biāo)法律保護(hù)被濫用和異化的一個(gè)重要原因。 本文從三個(gè)方面論述對(duì)馳名商標(biāo)認(rèn)定和權(quán)利行使的限制,第一部分從馳名商標(biāo)認(rèn)定和權(quán)利行使限制的合理性出發(fā),對(duì)馳名商標(biāo)的認(rèn)定和權(quán)利行使的現(xiàn)狀加以闡述,并分析我國馳名商標(biāo)在這兩方面存在的問題,以及我國對(duì)馳名商標(biāo)認(rèn)定和權(quán)利行使加以限制的必要性和可行性。從禁止權(quán)利濫用原則、利益平衡原則和公平市場(chǎng)競(jìng)爭(zhēng)的需要等理論出發(fā),為馳名商標(biāo)認(rèn)定和權(quán)利行使限制提供理論支撐,并從理論和實(shí)踐的角度對(duì)馳名商標(biāo)認(rèn)定和權(quán)利行使限制的可行性加以論述。第二部分直接從我國馳名商標(biāo)在認(rèn)定中存在的問題入手,對(duì)認(rèn)定進(jìn)行嚴(yán)格的限制,首先對(duì)馳名商標(biāo)認(rèn)定的司法和行政主體分別限制,并提出對(duì)認(rèn)定主體的立法建議。其次,對(duì)馳名商標(biāo)認(rèn)定的標(biāo)準(zhǔn)加以限制,對(duì)認(rèn)定標(biāo)準(zhǔn)的選擇加以限制,增加必要的認(rèn)定標(biāo)準(zhǔn),并對(duì)認(rèn)定標(biāo)準(zhǔn)進(jìn)行量化規(guī)定,最后對(duì)馳名商標(biāo)的認(rèn)定效力從認(rèn)定的約束力和追溯力兩個(gè)方面加以限制。第三部分從馳名商標(biāo)權(quán)利人權(quán)利行使的角度對(duì)馳名商標(biāo)權(quán)利加以限制,針對(duì)馳名商標(biāo)權(quán)利人權(quán)利濫用的幾個(gè)問題：分別對(duì)“馳名商標(biāo)”字樣用于廣告宣傳,限制他人對(duì)馳名商標(biāo)的合理使用,限制在先權(quán)利人的權(quán)利行使以及馳名商標(biāo)權(quán)利人任意的許可使用和轉(zhuǎn)讓馳名商標(biāo)等問題,逐一加以限制,并對(duì)許可使用和轉(zhuǎn)讓規(guī)定嚴(yán)格的程序。在完善法律法規(guī)的同時(shí),還要加強(qiáng)權(quán)利人及社會(huì)公眾對(duì)馳名商標(biāo)制度的認(rèn)識(shí),從多方面對(duì)馳名商標(biāo)法律制度加以規(guī)范和限制,從而使我國的馳名商標(biāo)保護(hù)制度更完善。
[Abstract]:With the development of intellectual property rights, trademark rights are paid more and more attention. Because the well-known trademark is the guarantee of the quality and the word of mouth, the law gives the well-known trademark a higher protection than the ordinary trademark, but the problem will arise if the right is given without restriction, which leads to the abuse of the trademark right by the well-known trademark owner. To impair the interests of other trademark owners. However, there are still many deficiencies in the law of our country in the recognition of well-known trademarks and the restriction of the exercise of rights, which is an important reason for the abuse and alienation of the legal protection of well-known trademarks. This article discusses the limitation of the well-known trademark and the exercise of the right from three aspects. The first part, from the rationality of the well-known trademark and the exercise of the right, expounds the status quo of the recognition and the exercise of the right of the well-known trademark. It also analyzes the problems existing in these two aspects, and the necessity and feasibility of restricting the recognition and exercise of the well-known trademark in our country. Based on the theories of the principle of prohibiting abuse of rights, the principle of balance of interests and the need of fair market competition, it provides theoretical support for the recognition of well-known trademarks and the restriction of the exercise of rights. From the angle of theory and practice, this paper discusses the feasibility of well-known trademark recognition and the restriction of the exercise of right. The second part directly from our well-known trademark in the identification of the existing problems, the identification of strict restrictions, first of all, the well-known trademark recognition of the judicial and administrative subjects, respectively, and put forward legislative recommendations to the subject. Secondly, restrict the standard of well-known trademark, limit the choice of the standard, increase the necessary standard, and quantify the standard. Finally, the validity of well-known trademark is restricted from two aspects: binding force and retroactive force. The third part limits the right of well-known trademark from the angle of the exercise of the right of the owner of well-known trademark, aiming at several problems of abuse of the right of the owner of well-known trademark: the words "well-known trademark" are used for advertising propaganda, respectively. Restrictions on the rational use of well-known trademarks by others, the exercise of the rights of the prior right holders and the arbitrary licensing and transfer of well-known trademarks by the owners of well-known trademarks shall be restricted one by one. And the licensing and transfer of strict procedures. At the same time of perfecting laws and regulations, it is necessary to strengthen the understanding of the well-known trademark system by the obligee and the public, and to regulate and restrict the legal system of well-known trademark from many aspects, so as to perfect the protection system of well-known trademark in our country.
