【摘要】：21世紀(jì),世界進(jìn)入了知識經(jīng)濟(jì)時代,經(jīng)濟(jì)的全球化將進(jìn)一步強(qiáng)化競爭和合作的機(jī)制。企業(yè)在面對更大市場的同時也不得不面對更加復(fù)雜的競爭環(huán)境。中國加入WTO之后,越來越多的國外汽車企業(yè)進(jìn)入中國市場。與國外汽車企業(yè)相比,中國汽車企業(yè)的實力相對較弱,因此中國的汽車企業(yè)面臨了更加激烈的競爭。專利制度有力地保護(hù)了發(fā)明人的權(quán)益,如果汽車企業(yè)能夠恰當(dāng)?shù)剡\(yùn)用專利制度賦予的自身權(quán)利,不僅可以增強(qiáng)自身實力,而且可以遏制競爭對手,搶占市場份額。所以研究汽車企業(yè)專利制度具有重要的現(xiàn)實意義。 基于上述研究問題,本文采用了實地調(diào)研法,案例分析法、數(shù)據(jù)分析法等,分析研究了國內(nèi)外汽車專利申請情況,重點分析了東風(fēng)柳汽公司專利申請和專利管理工作。 本論文的研究工作主要集中在以下幾個方面問題： 首先通過對企業(yè)專利制度的內(nèi)涵和企業(yè)專利制度的基本特征的介紹對企業(yè)專利制度進(jìn)行了簡單的闡述。然后對東風(fēng)柳汽專利制度現(xiàn)狀做出分析,包括東風(fēng)柳汽知識產(chǎn)權(quán)概況、專利制度建設(shè)現(xiàn)狀、專利制度建設(shè)存在的缺陷三部分。最后借鑒美國日本等發(fā)達(dá)國家汽車企業(yè)實施的專利制度成功經(jīng)驗,解析東風(fēng)汽車公司和奇瑞汽車公司專利制度,結(jié)合東風(fēng)柳汽的實際情況分析制定了適合東風(fēng)柳汽公司的專利制度。這些專利制度具體包括東風(fēng)柳汽的專利創(chuàng)造制度、專利運(yùn)用制度、專利保護(hù)制度、專利管理制度。 通過對東風(fēng)柳汽公司專利工作的實際調(diào)查,筆者指出東風(fēng)柳汽專利管理存在專利意識薄弱、專利申請量偏低,科研投入少,技術(shù)創(chuàng)新能力低,缺乏科學(xué)、系統(tǒng)、整體性的專利制度規(guī)劃等問題�；谏鲜鲅芯�,筆者針對性地提出了東風(fēng)柳汽專利制度的對策和建議。例如完善公司專利管理制度,提高員工的專利意思；加大科研投入力度,提高東風(fēng)柳汽創(chuàng)新能力；做好技術(shù)引進(jìn)工作,重視引進(jìn)技術(shù)的消化、吸收、和創(chuàng)新；明確專利制度作用,制定合適的方案。
[Abstract]:In the 21st century, the world has entered the era of knowledge economy, and the globalization of economy will further strengthen the mechanism of competition and cooperation. Enterprises in the face of a larger market but also have to face a more complex competitive environment. After China joins WTO, more and more foreign automobile enterprises enter Chinese market. Compared with foreign automobile enterprises, the strength of Chinese automobile enterprises is relatively weak, so Chinese automobile enterprises are facing more fierce competition. The patent system can protect the rights and interests of inventors powerfully. If automobile enterprises can make proper use of the rights granted by the patent system, they can not only strengthen their own strength, but also restrain their competitors and seize the market share. Therefore, it is of great practical significance to study the patent system of automobile enterprises. Based on the above research problems, this paper adopts field investigation, case analysis, data analysis and so on, analyzes the domestic and foreign automobile patent application situation, and analyzes the patent application and patent management work of Dongfeng Liuqi Company. The research work of this paper mainly focuses on the following aspects: firstly, the author introduces the connotation of the enterprise patent system and the basic characteristics of the enterprise patent system. Then it analyzes the current situation of Dongfeng Liuqi patent system, including the general situation of Dongfeng Liuqi intellectual property rights, the current situation of patent system construction, the defects of patent system construction. Finally, drawing lessons from the successful experience of the patent system implemented by automobile enterprises in developed countries such as the United States and Japan, we analyze the patent system of Dongfeng Motor Company and Chery Motor Company. According to the actual situation of Dongfeng Liuqi, the patent system suitable for Dongfeng Liuqi Company is established. These patent systems include Dongfeng Liuqi's patent creation system, patent application system, patent protection system and patent management system. Through the actual investigation of the patent work of Dongfeng Liuqi Company, the author points out that the patent management of Dongfeng Liuqi has weak patent consciousness, low patent application, low scientific research investment, low technological innovation ability, lack of science and system, etc. The whole patent system plan and so on. Based on the above research, the author puts forward the countermeasures and suggestions of Dongfeng Liuqi patent system. For example, improve the patent management system of the company, improve the patent meaning of the staff; increase the scientific research investment, improve the innovation ability of Dongfeng Liuqi, do the work of technology introduction, attach importance to the digestion, absorption, and innovation of the imported technology; Clarify the role of the patent system and formulate appropriate programs.
