【摘要】：軟件服務化（SaaS）雖然在中國還是個剛剛興起的新生事物，但是由于國內(nèi)具有非常良好的生長土壤，目前備受業(yè)界的關注。在傳統(tǒng)的軟件模式下，大部分法律法規(guī)僅針對有形作品做出了出租權(quán)的規(guī)定，，然而隨著科學技術(shù)和互聯(lián)網(wǎng)廣泛應用的發(fā)展，一種以軟件在線租用方式為企業(yè)用戶提供軟件出租服務的應用模式逐漸興起。這種以電子出租形式為核心的服務模式，對傳統(tǒng)的軟件許可模式產(chǎn)生了巨大的沖擊，同時對傳統(tǒng)的作品出租也提出了新的挑戰(zhàn)，這能否被現(xiàn)今著作權(quán)制度所保護，能否納入出租權(quán)的保護范疇，不同的學者有著不同的看法。 本文在總結(jié)現(xiàn)有關于SaaS模式下關于出租權(quán)研究的基礎上，通過文獻參考，綜合歸納，對比分析，案例分析等方法，系統(tǒng)的對SaaS模式下出租權(quán)制度進行了歸納分析，文章共分為四個部分：第一部分主要介紹了本文的研究背景、意義、國內(nèi)外研究的現(xiàn)狀及本文寫作的手法；第二部分介紹了SaaS及SaaS模式下的出租權(quán)基本概念及基礎理論；第三部分主要詳細分析了SaaS模式下軟件的應用情況，并總結(jié)得出SaaS模式下適用出租權(quán)制度的優(yōu)越性及其理論基礎；第四部分論述了SaaS模式下出租權(quán)制度重塑的可行性分析及提出了立法建議。綜上得出，在科技日新月異發(fā)展的今天和互聯(lián)網(wǎng)廣泛應用的時代，為適應軟件在線出租這種新經(jīng)濟模式的應用，出臺新的發(fā)展政策，完善出租權(quán)法律政策，加強監(jiān)管，構(gòu)建完善的知識產(chǎn)權(quán)保護制度，已成為必然趨勢。
[Abstract]:Although software service (SaaS) is still a newly emerging thing in China, it has attracted the attention of the industry because of its very good growth soil. In the traditional software model, most laws and regulations only provide for the rental rights of tangible works. However, with the development of science and technology and the wide application of the Internet, An application mode of providing software rental service to enterprise users by software online lease is emerging. This kind of service mode, which is based on electronic rental, has a great impact on the traditional software licensing mode, at the same time, it also puts forward new challenges to the traditional works rental, which can be protected by the present copyright system. Different scholars have different views on whether they can be included in the scope of protection of rental rights. On the basis of summarizing the existing research on the rental right under the SaaS model, this paper systematically analyzes the rental right system under the SaaS model through the methods of literature reference, comprehensive induction, comparative analysis, case analysis and so on. The article is divided into four parts: the first part mainly introduces the research background, significance, domestic and foreign research status and writing methods, the second part introduces the basic concept and theory of SaaS and SaaS. The third part mainly analyzes the application of software in SaaS mode in detail, and concludes the superiority and theoretical basis of applying rent right system in SaaS mode. The fourth part discusses the feasibility analysis and legislative suggestion of rent right system remoulding under SaaS mode. In summary, in the era of rapid development of science and technology and the widespread use of the Internet, in order to adapt to the application of the new economic model of software online leasing, new development policies have been issued, legal policies on rental rights have been improved, and supervision has been strengthened. It has become an inevitable trend to construct a perfect intellectual property protection system.
