【摘要】：隨著知識經(jīng)濟時代的到來，新的市場競爭規(guī)則已然確立，“技術專利化，專利標準化，標準許可化”是對當前企業(yè)標準競爭的最形象描述。技術標準化過程中，通過技術優(yōu)化，提高了生產(chǎn)效率；通過簡化產(chǎn)品種類，提高了規(guī)模經(jīng)濟效率；通過可靠的質(zhì)量預期，保護了消費者福利。然而，技術標準化是一把“雙刃劍”，在技術標準化過程中持有者可以通過設置市場進入壁壘，排斥其他競爭者進入相關市場，謀取并維持壟斷地位，獲取超額利潤，因此而實施限制市場競爭的行為。有鑒于此，，技術標準化中的限制競爭行為越來越受到反壟斷法理論界和反壟斷執(zhí)法、司法的重視。 本文擬從技術標準化與反壟斷法的一般理論入手，介紹技術標準及技術標準化的概念及技術標準化對市場競爭影響的利弊，論文著重分析技術標準化中限制競爭行為的反壟斷法規(guī)制，采用比較有特色的以主體為主，主體結(jié)合行為的研究方法，從行業(yè)協(xié)會、企業(yè)聯(lián)盟和企業(yè)三種不同主體的角度分析技術標準化行為中限制競爭行為特點及反壟斷法規(guī)制，進而提出對完善我國反壟斷法對技術標準化中限制競爭行為的規(guī)制的建議。最后，在借鑒國外的經(jīng)驗的基礎上，提出了在我國制定《知識產(chǎn)權領域反壟斷執(zhí)法指南》、確立以合理原則為基礎的分析原則、注重與技術創(chuàng)新的關系等完善立法和改進執(zhí)法方面的建議。
[Abstract]:With the arrival of the era of knowledge economy, the new rules of market competition have been established. "Technology patent, patent standardization, standard licensing" is the most vivid description of the current enterprise standard competition. In the process of technological standardization, the production efficiency is improved through technological optimization, the efficiency of scale economy is improved by simplifying the product category, and the consumer welfare is protected by reliable quality expectation. However, technology standardization is a "double-edged sword". In the process of technology standardization, holders can set up market entry barriers, exclude other competitors from entering relevant markets, seek and maintain monopoly status, and obtain excess profits. Therefore, the implementation of restrictions on market competition behavior. In view of this, the restrictive competition behavior in the technology standardization is paid more and more attention by the antimonopoly law theorists and the antimonopoly law enforcement and the judicature. Starting with the general theory of technology standardization and antimonopoly law, this paper introduces the concepts of technology standard and technology standardization, and the advantages and disadvantages of technology standardization on market competition. This paper focuses on the analysis of the regulation of anti-monopoly law, which restricts the competition behavior in the technical standardization, and adopts the characteristic research method of subject-oriented, subject-combining behavior, from the trade association, This paper analyzes the characteristics of restrictive competition behavior and the regulation of anti-monopoly law in the behavior of technological standardization from the angles of three different subjects of enterprise alliance and enterprise, and then puts forward some suggestions on how to perfect the regulation of restricting competition behavior in the process of technological standardization in China's anti-monopoly law. Finally, on the basis of drawing lessons from foreign experience, the paper puts forward the analytical principles based on the reasonable principle to establish the Guide for Anti-monopoly Law Enforcement in the Field of intellectual property in China. Focus on the relationship with technological innovation and improve legislation and improve law enforcement recommendations.
