【摘要】:隨著我國(guó)市場(chǎng)經(jīng)濟(jì)的不斷發(fā)展以及全球貿(mào)易的日益發(fā)達(dá),有關(guān)知名商品的保護(hù)已經(jīng)成為世界各國(guó)不容忽視的一個(gè)問(wèn)題。不法商家在商業(yè)活動(dòng)當(dāng)中仿冒知名商品的“搭便車”行為也日益猖獗。此種模仿行為不僅僅會(huì)對(duì)知名商品本身造成惡劣的影響,也會(huì)在社會(huì)大眾之間造成混淆。因此,為了構(gòu)造一個(gè)良好的商業(yè)競(jìng)爭(zhēng)環(huán)境,保護(hù)企業(yè)的商業(yè)成果以及消費(fèi)者的切身利益,如何為知名商品提供更好的法律保護(hù)是我國(guó)所面對(duì)的重要問(wèn)題。本文共分為五章:在第一章中,筆者主要論述了知名商品的定義、知名商品的保護(hù)范圍、知名商品的特征以及保護(hù)知名商品的現(xiàn)實(shí)意義;第二章筆者介紹了知名商品同我們傳統(tǒng)意義上知識(shí)產(chǎn)權(quán)的區(qū)別,并從理論和現(xiàn)實(shí)層面論述了保護(hù)知名商品的原則;第三章是比較法研究,筆者通過(guò)對(duì)國(guó)際條約、美國(guó)、日本、韓國(guó)和德國(guó)等發(fā)達(dá)國(guó)家相關(guān)法律的研究,分析了其在立法層面值得我國(guó)借鑒的優(yōu)勢(shì)之處;第四章論述了知名商品在我國(guó)保護(hù)的現(xiàn)狀,比如如何認(rèn)定商品的“知名性”以及關(guān)于混淆的界定,并闡述我國(guó)現(xiàn)階段在保護(hù)知名商品方面有哪些的不足,提出了自己的見(jiàn)解。通過(guò)以上的論述,筆者認(rèn)為,加強(qiáng)對(duì)知名商品的保護(hù)力度范圍不僅可以維護(hù)一個(gè)良好的市場(chǎng)秩序,而且還能夠更加有效的解決各知識(shí)產(chǎn)權(quán)權(quán)利之間的沖突。同時(shí),為提高我國(guó)在國(guó)際競(jìng)爭(zhēng)中的形象也有著不可忽視的作用。
[Abstract]:With the development of China's market economy and the development of global trade, the protection of well-known commodities has become a problem that can not be ignored in the world. Illegal merchants in commercial activities counterfeit famous goods, "hitchhiking" behavior is increasingly rampant. This kind of imitation will not only have a bad effect on the famous goods themselves, but also cause confusion among the public. Therefore, in order to construct a good commercial competition environment, to protect the business achievements of enterprises and the vital interests of consumers, how to provide better legal protection for well-known commodities is an important problem facing our country. This paper is divided into five chapters: in the first chapter, the author mainly discusses the definition of well-known goods, the scope of protection of well-known goods, the characteristics of well-known goods and the practical significance of protecting well-known commodities; In the second chapter, the author introduces the differences between well-known goods and our traditional intellectual property rights, and discusses the principles of protecting well-known goods from the theoretical and practical aspects. Chapter three is a comparative law study, the author through the international treaties, the United States, Japan, South Korea and Germany and other developed countries related law research, analyzed its legislative level worthy of our country to learn from the advantages; the fourth chapter discusses the status quo of well-known goods in China, For example, how to identify the "well-known" of goods and the definition of confusion, and explain what are the deficiencies in the protection of well-known commodities in our country at this stage, and put forward their own views. Through the above discussion, the author believes that strengthening the scope of protection of well-known commodities can not only maintain a good market order, but also more effectively solve the conflict between intellectual property rights. At the same time, in order to improve the image of our country in the international competition also plays an important role.
