【摘要】：個(gè)人利益與公眾利益是知識(shí)產(chǎn)權(quán)制度調(diào)整的利益關(guān)系中的主要矛盾,適當(dāng)平衡個(gè)人利益與公眾利益是知識(shí)產(chǎn)權(quán)制度設(shè)計(jì)和完善的關(guān)鍵所在。無論是實(shí)現(xiàn)知識(shí)產(chǎn)權(quán)權(quán)利人的利益,還是滿足公眾對(duì)知識(shí)產(chǎn)品合理需求的利益,都是促進(jìn)人的發(fā)展和社會(huì)經(jīng)濟(jì)發(fā)展的必然要求。以人為本理念作為馬克思主義唯物史觀的深化理論,強(qiáng)調(diào)的就是在滿足人們?nèi)找嬖鲩L(zhǎng)的物質(zhì)文化需要基礎(chǔ)上,保障人的發(fā)展,并促進(jìn)社會(huì)經(jīng)濟(jì)的和諧發(fā)展。因此,本文在作知識(shí)產(chǎn)權(quán)個(gè)人利益與公眾利益的平衡研究時(shí),緊緊圍繞科學(xué)發(fā)展觀的以人為本核心思想。從以人為本的角度出發(fā),對(duì)知識(shí)產(chǎn)權(quán)制度的功能進(jìn)行考察和對(duì)個(gè)人利益與公眾利益的沖突表現(xiàn)進(jìn)行歸納分析。并把以人為本理念作為分析知識(shí)產(chǎn)權(quán)制度設(shè)計(jì)和完善的指導(dǎo)思想和衡量標(biāo)準(zhǔn),貫穿評(píng)價(jià)和完善知識(shí)產(chǎn)權(quán)制度在平衡個(gè)人利益與公眾利益具體措施的始終。 法律制度作為一種具有國家強(qiáng)制力的有效調(diào)控手段,是促進(jìn)社會(huì)經(jīng)濟(jì)發(fā)展、協(xié)調(diào)社會(huì)關(guān)系的必要措施,法律制度的完善必須符合社會(huì)發(fā)展的需求,因此以人為本理念對(duì)法律制度研究具有重要指導(dǎo)意義。以人為本理念對(duì)法律制度的指導(dǎo)意義具體到知識(shí)產(chǎn)權(quán)制度領(lǐng)域就表現(xiàn)為,知識(shí)產(chǎn)權(quán)制度對(duì)個(gè)人利益與公眾利益的協(xié)調(diào)以實(shí)現(xiàn)對(duì)人的地位的肯定、對(duì)人的利益的滿足和對(duì)人的權(quán)利的尊重為制度完善的目標(biāo),進(jìn)而達(dá)到能夠更加充分發(fā)揮人的作用的效果,最終促進(jìn)人和社會(huì)經(jīng)濟(jì)的共同發(fā)展。知識(shí)產(chǎn)權(quán)制度肩負(fù)著激勵(lì)創(chuàng)新和保障知識(shí)傳播的雙重任務(wù),既要著眼于保障人的發(fā)展,又要加大力度促進(jìn)社會(huì)的發(fā)展。因此,知識(shí)產(chǎn)權(quán)制度要完善適當(dāng)?shù)臋?quán)利保障制度與合理的限制制度設(shè)計(jì),即要充分保護(hù)知識(shí)產(chǎn)權(quán)權(quán)利人的應(yīng)有權(quán)利,又要防止和平衡權(quán)利的擴(kuò)張、行使不當(dāng)?shù)仍蛟斐傻呐c公眾利益之間的沖突。在保障知識(shí)產(chǎn)品創(chuàng)新的基礎(chǔ)上促進(jìn)科技發(fā)展和社會(huì)經(jīng)濟(jì)的進(jìn)步,不僅是知識(shí)產(chǎn)權(quán)制度完善的必然要求,更是以人為本理念指導(dǎo)下的知識(shí)產(chǎn)權(quán)制度完善的必然選擇。 因此,將以人為本理念作為知識(shí)產(chǎn)權(quán)個(gè)人利益與公眾利益平衡研究的指導(dǎo)思想,既是對(duì)知識(shí)產(chǎn)權(quán)制度的理論完善和豐富,也是以人為本理念在實(shí)踐中的具體深化。無論是從適應(yīng)國家知識(shí)產(chǎn)權(quán)戰(zhàn)略要求的角度還是從實(shí)現(xiàn)十八大提出的建成小康社會(huì)的目標(biāo)角度而論,對(duì)于促進(jìn)人的發(fā)展和社會(huì)經(jīng)濟(jì)的發(fā)展具有重要的理論和現(xiàn)實(shí)意義。
[Abstract]:Personal interest and public interest are the main contradictions in the interest relationship of intellectual property system adjustment. The key to the design and perfection of intellectual property system is to properly balance personal interest and public interest. Whether it is to realize the interests of intellectual property rights holders or to satisfy the interests of the public on the reasonable demand for knowledge products, it is an inevitable requirement to promote the development of human beings and social economy. As the deepening theory of Marxist historical materialism, the people-oriented concept emphasizes that on the basis of satisfying people's increasing material and cultural needs, it can guarantee the development of human beings and promote the harmonious development of social economy. Therefore, in the study of the balance between intellectual property rights and public interests, this paper focuses on the people-oriented core idea of scientific development. From the point of view of people-oriented, this paper investigates the function of intellectual property system and analyzes the conflict between individual interests and public interests. The idea of "people-oriented" is taken as the guiding ideology and measurement standard for analyzing the design and perfection of intellectual property system, which runs through the process of evaluating and perfecting the intellectual property system in balancing the individual interests with the specific measures of the public interest. As an effective means of regulation and control with national coercive power, the legal system is a necessary measure to promote the social and economic development and coordinate social relations. The perfection of the legal system must meet the needs of social development. Therefore, the idea of people-oriented is of great significance to the study of legal system. The guiding significance of the people-oriented concept to the legal system is embodied in the field of intellectual property system. The coordination between the individual interests and the public interests in the intellectual property rights system can realize the affirmation of the status of the human being. The satisfaction of human interests and respect for human rights are the goal of perfecting the system, thus achieving the effect of giving full play to the role of human beings, and finally promoting the common development of human and social economy. Intellectual property system shoulders the dual task of encouraging innovation and guaranteeing knowledge dissemination. It not only focuses on the development of human beings, but also promotes the development of society. Therefore, the intellectual property system should perfect the proper right protection system and reasonable restriction system design, that is, to fully protect the due rights of the holders of intellectual property rights, and to prevent and balance the expansion of the rights. Conflict with the public interest caused by improper exercise, etc. To promote the development of science and technology and the progress of social economy on the basis of guaranteeing innovation of knowledge products is not only an inevitable requirement for the perfection of intellectual property system, but also an inevitable choice for the perfection of intellectual property system under the guidance of people-oriented concept. Therefore, it is not only the perfection and enrichment of the theory of intellectual property rights system, but also the concrete deepening of the people-oriented concept in practice to regard the people-oriented concept as the guiding ideology of the research on the balance of intellectual property rights' individual interests and public interests. Whether from the angle of adapting to the national intellectual property strategy or realizing the goal of building a well-off society put forward by the 18th National Congress, it has important theoretical and practical significance for the promotion of human development and the development of social economy.
