【摘要】：從改革開放的第一天起,引進外資就成為了我國實行跨越式經(jīng)濟發(fā)展戰(zhàn)略的主要策略,而經(jīng)濟建設(shè)的成功也為這條策略打下了"不敗"的烙印,甚至它也被移作為我國產(chǎn)業(yè)升級的圣經(jīng),用"市場換技術(shù)"的構(gòu)想一度成為了我國科技興國戰(zhàn)略的指導(dǎo)方針。但是,近30年的實踐證明,不僅"市場換技術(shù)"的預(yù)期未能實現(xiàn),反而面臨"井噴"式外資并購浪潮,民族企業(yè)的生存空間被壓縮,經(jīng)濟安全面臨外國戰(zhàn)略性產(chǎn)業(yè)的蠶食和侵吞后可能造成嚴重的后果。因此,從知識產(chǎn)權(quán)法的角度對我國外資控制進行研究很有必要。
[Abstract]:Since the first day of reform and opening up, the introduction of foreign capital has become the main strategy for China's implementation of a leapfrog economic development strategy, and the success of economic construction has also created the brand of "undefeated" for this strategy. Even it was moved as the bible of China's industrial upgrading, and the idea of "market for technology" once became the guiding principle of China's strategy of rejuvenating the country through science and technology. However, the practice in the past 30 years has proved that not only the expectation of "market for technology" has not been realized, but also the "blowout" wave of foreign capital mergers and acquisitions has been faced with, and the living space of national enterprises has been compressed. Economic security may result in serious consequences after the encroachment and embezzlement of foreign strategic industries. Therefore, it is necessary to study the control of foreign capital from the angle of intellectual property law.
