【摘要】：知識產權是體育賽事運營過程中不可或缺的重要組成部分之一,目前在我國體育賽事的高速發(fā)展期,體育賽事的知識產權保護尤為重要。但是,目前我國體育賽事知識產權保護方面仍舊存在諸多亟待解決的問題,對我國體育賽事的健康發(fā)展造成了嚴重制約。認清現(xiàn)狀,梳理原因,探討對策,加強我國體育賽事知識產權的法律實踐保護,有著極其重要的意義。本研究從體育賽事、知識產權、體育賽事知識產權等基本概念的界定出發(fā),分析了體育賽事與知識產權客體關系,總結了當前國內體育賽事知識產權侵權的典型類型,并從立法、執(zhí)法和司法等三個方面系統(tǒng)分析了我國體育賽事知識產權法律實踐保護現(xiàn)狀,深入分析了我國體育賽事知識產權法律實踐保護存在問題及原因,以美國奧林匹克知識產權保護為例分析了國外體育賽事知識產權法律實踐保護經驗,在此基礎上提出了處理好體育賽事知識產權的在先權利保護問題的措施。本研究能夠進一步豐富我國體育賽事知識產權保護的理論研究體系,為體育賽事知識產權保護體系的建立及完善提供理論支撐,為體育部門管理部門的改革提供一定的參考。通過研究發(fā)現(xiàn),我國體育賽事知識產權保護中存在相關法律嚴重缺失、侵權事件發(fā)生頻率高、侵權事件發(fā)現(xiàn)不及時及侵權案件法律評判標準不一等諸多問題,理論研究不足及國家重視程度不夠,執(zhí)法主體不明確、法律級別低,以及民眾與體育產業(yè)從業(yè)者知識產權保護意識不強等是導致問題出現(xiàn)的根本原因。借鑒美國《奧林匹克與業(yè)余體育法》的經驗與做法,加強我國體育賽事知識產權的保護要加快我國體育賽事知識產權立法進程,加大我國體育賽事知識產權執(zhí)法力度,完善我國體育賽事知識產權司法保護體系,此外還要加強公眾及企業(yè)的體育賽事知識產權守法意識。
[Abstract]:Intellectual property rights (IPR) is one of the most important parts in the process of running sports events. At present, in the period of rapid development of sports events in China, the protection of intellectual property rights of sports events is particularly important. However, at present, there are still many problems to be solved in the protection of intellectual property rights of sports events in China, which has seriously restricted the healthy development of sports events in China. It is of great significance to recognize the present situation, to comb the reasons, to explore the countermeasures and to strengthen the legal practice protection of intellectual property rights of sports events in China. Based on the definition of sports events, intellectual property rights and intellectual property rights of sports events, this study analyzes the relationship between sports events and intellectual property rights, and summarizes the typical types of intellectual property rights infringement in domestic sports events. And from three aspects of legislation, law enforcement and judicature, this paper systematically analyzes the current situation of the legal protection of intellectual property rights of sports events in China, and deeply analyzes the existing problems and reasons of the legal practice protection of intellectual property rights of sports events in China. Taking the American Olympic intellectual property protection as an example, this paper analyzes the experience of the legal protection of intellectual property rights in foreign sports events, and puts forward some measures to deal with the protection of the intellectual property rights of sports events in the first place. This study can further enrich the theoretical research system of intellectual property protection of sports events in China, provide theoretical support for the establishment and improvement of intellectual property protection system of sports events, and provide a certain reference for the reform of the management department of sports departments. Through the research, it is found that there are many problems in the protection of intellectual property rights of sports events in China, such as serious lack of relevant laws, high frequency of infringement incidents, untimely discovery of infringement incidents and different legal judgment standards of infringement cases. Insufficient theoretical research and insufficient attention of the state, unclear subject of law enforcement, low level of law, and weak awareness of intellectual property protection among the public and practitioners of the sports industry are the root causes of the problem. Drawing on the experience and practice of the Olympic and amateur sports law of the United States, to strengthen the protection of intellectual property rights of sports events in our country, we should speed up the legislative process of intellectual property rights of sports events in our country and strengthen the enforcement of intellectual property rights of sports events in our country. In addition to perfecting the judicial protection system of intellectual property rights of sports events in our country, we should strengthen the awareness of the public and enterprises of abiding by the law of intellectual property rights of sports events.
