大學(xué)生知識產(chǎn)權(quán)法律意識及其培育研究

【摘要】:近年我國的知識產(chǎn)權(quán)法制建設(shè)進(jìn)程逐漸加快,立法工作取得了較大進(jìn)展,知識產(chǎn)權(quán)社會關(guān)注度不斷提升,但知識產(chǎn)權(quán)侵權(quán)現(xiàn)象仍舊普遍存在,這固然與知識產(chǎn)權(quán)法律執(zhí)行力不足有關(guān),知識產(chǎn)權(quán)法律意識的缺乏是導(dǎo)致這種局面的重要原因之一。高校大學(xué)生作為國家未來發(fā)展的中堅力量,大學(xué)生的知識產(chǎn)權(quán)法律意識水平對法治國家建設(shè)至關(guān)重要,因此培育大學(xué)生知識產(chǎn)權(quán)法律意識對全面推進(jìn)依法治國、建設(shè)創(chuàng)新型國家以及實現(xiàn)知識產(chǎn)權(quán)法律價值的意義重大。本文以大學(xué)生知識產(chǎn)權(quán)法律意識為研究內(nèi)容,從以下方面對我國大學(xué)生知識產(chǎn)權(quán)法律意識及其培育進(jìn)行論述。首先,簡要闡述本文的研究背景、研究現(xiàn)狀以及研究思路和方法,然后對法律意識的基礎(chǔ)理論進(jìn)行分析,從法律意識概念、結(jié)構(gòu)與功能著手,界定大學(xué)生知識產(chǎn)權(quán)法律意識的內(nèi)涵,厘清知識產(chǎn)權(quán)法律意識概念、明晰知識產(chǎn)權(quán)法律意識結(jié)構(gòu);其次,對大學(xué)生知識產(chǎn)權(quán)法律意識展開實證研究,基于知識產(chǎn)權(quán)法律意識的理論分析,將大學(xué)生知識產(chǎn)權(quán)法律意識調(diào)查內(nèi)容轉(zhuǎn)化為問卷形式。問卷設(shè)計是本文的重要環(huán)節(jié),通過專家老師指正、受訪對象預(yù)調(diào)查后先后進(jìn)行四次修改方最終確定問卷內(nèi)容,而后在選取樣本中開展調(diào)查研究并經(jīng)分析后認(rèn)為:我國大學(xué)生知識產(chǎn)權(quán)法律意識呈現(xiàn)出差異性、矛盾性、和發(fā)展性三大特點,整體來看我國大學(xué)生知識產(chǎn)權(quán)法律意識狀況仍舊淡薄,主要表現(xiàn)在知識產(chǎn)權(quán)法律知識儲備不足、知識產(chǎn)權(quán)法律情感嚴(yán)重匱乏、知識產(chǎn)權(quán)法律意志不夠堅定、知識產(chǎn)權(quán)法律信仰嚴(yán)重缺失四個方面,筆者認(rèn)為造成大學(xué)生知識產(chǎn)權(quán)法律意識淡薄的主要原因是我國的知識產(chǎn)權(quán)教育模式影響法律知識傳播、知識產(chǎn)權(quán)法律環(huán)境不夠完善、知識產(chǎn)權(quán)法律缺乏歷史文化土壤、商品經(jīng)濟(jì)與網(wǎng)絡(luò)發(fā)展帶來的負(fù)面影響;最后,依據(jù)問卷調(diào)查分析結(jié)果對我國大學(xué)生知識產(chǎn)權(quán)法律意識的培育進(jìn)行闡述,對大學(xué)生知識產(chǎn)權(quán)法律意識進(jìn)行培育要遵循大學(xué)生知識產(chǎn)權(quán)法律意識與知識產(chǎn)權(quán)法律制度相匹配、與大學(xué)生法律知識水平相適應(yīng)、與我國歷史文化相融合的原則,從而進(jìn)一步確定培育大學(xué)生知識產(chǎn)權(quán)法律意識的路徑,筆者試圖通過夯實大學(xué)生知識產(chǎn)權(quán)法律知識基礎(chǔ)、完善知識產(chǎn)權(quán)法律環(huán)境、矯正大學(xué)生價值取向等路徑,對我國大學(xué)生的知識產(chǎn)權(quán)法律意識進(jìn)行培育。
[Abstract]:In recent years, the process of legal construction of intellectual property in China has been gradually accelerated, the legislative work has made great progress, and the social attention of intellectual property has been rising, but the phenomenon of intellectual property infringement is still widespread. This is certainly related to the lack of enforcement of intellectual property law, and the lack of legal awareness of intellectual property is one of the important reasons leading to this situation. College students as the backbone of the future development of the country, the level of intellectual property legal awareness of college students is very important to the construction of a country ruled by law, so cultivating the legal awareness of intellectual property rights of college students will promote the rule of law in an all-round way. It is of great significance to build an innovative country and realize the legal value of intellectual property. In this paper, the intellectual property legal awareness of college students as the research content, from the following aspects of intellectual property legal awareness of Chinese college students and its cultivation are discussed. First of all, this paper briefly describes the research background, research status, research ideas and methods, and then analyzes the basic theory of legal consciousness, starting with the concept, structure and function of legal consciousness. Define the connotation of college students' intellectual property legal consciousness, clarify the concept of intellectual property legal consciousness, clarify the structure of intellectual property legal consciousness; secondly, carry out an empirical study on college students' intellectual property legal consciousness. Based on the theoretical analysis of intellectual property legal consciousness, the investigation content of intellectual property legal consciousness of college students is transformed into questionnaire form. Questionnaire design is an important link in this paper. Through the correction of experts and teachers, four revisions were carried out to determine the content of the questionnaire. Then it is concluded that the legal consciousness of intellectual property of college students in our country shows three characteristics: difference, contradiction, and development. On the whole, the status of intellectual property legal consciousness of college students in China is still weak, mainly reflected in the lack of intellectual property legal knowledge reserve, the serious lack of intellectual property legal emotion, and the lack of firm legal will in intellectual property rights. The author believes that the main reason for the weak awareness of intellectual property law among college students is that the intellectual property education mode of our country affects the dissemination of legal knowledge, and the legal environment of intellectual property is not perfect enough. The intellectual property law lacks the historical and cultural soil, the negative influence brought by the development of commodity economy and network. Finally, according to the result of questionnaire survey, the author expounds the cultivation of intellectual property legal consciousness of college students in China. To cultivate the legal consciousness of intellectual property of college students, we should follow the principle of matching the legal consciousness of intellectual property with the legal system of intellectual property, adapting to the level of legal knowledge of college students, and merging with the history and culture of our country. In order to further determine the path of cultivating college students' intellectual property legal consciousness, the author tries to improve the legal environment of intellectual property and correct the value orientation of college students by ramming the legal knowledge of intellectual property of college students. To cultivate the intellectual property legal consciousness of college students in our country.
