【摘要】：面對《跨太平洋伙伴關(guān)系協(xié)定》高標準壓力,當(dāng)下中國自貿(mào)區(qū)試點的外商投資法律體制改革面臨很大的不確定和曲折,并且將會面臨美國在負面清單問題解決之后把戰(zhàn)略重點轉(zhuǎn)向監(jiān)管障礙、競爭政策、原材料和能源、環(huán)境和勞工標準、知識產(chǎn)權(quán)強保護等新興議題上,為全球貿(mào)易自由化設(shè)定更高的標準。因此,中國應(yīng)當(dāng)更多從被動應(yīng)對的規(guī)則執(zhí)行者逐步成長為主動參與的規(guī)則引領(lǐng)者,以中美雙邊投資協(xié)定、中歐雙邊投資協(xié)定談判為契機,借助于中國自貿(mào)區(qū)的進一步試驗,結(jié)合國內(nèi)深化改革和產(chǎn)業(yè)升級情況,探索建立高水平負面清單之后的責(zé)任門檻機制,以及面對環(huán)境保護、勞工規(guī)則、競爭中立、知識產(chǎn)權(quán)等新興的營商責(zé)任法治化敏感議題進行整體規(guī)劃和設(shè)計,為構(gòu)建有影響力的中國外商投資法律話語體系奠定良好基礎(chǔ)。當(dāng)然,中國自貿(mào)區(qū)的外商投資法律體制改革既應(yīng)不斷對接國際高標準,又要結(jié)合中國實際情況,構(gòu)建邁向深水區(qū)改革不可或缺的中國話語體系。
[Abstract]:In the face of the high standard pressure of the "Trans-Pacific Partnership Agreement", the current reform of the foreign investment legal system in China's FTAA pilot projects faces great uncertainty and twists and turns. And will face emerging issues such as regulatory barriers, competition policy, raw materials and energy, environmental and labour standards, strong intellectual property protection, and other emerging issues that the United States will shift its strategic focus to after the negative list problem has been resolved. Set higher standards for global trade liberalization. Therefore, China should gradually grow from a passive response executor to an active rule leader, taking Sino-US bilateral investment agreements and China-EU bilateral investment treaty negotiations as an opportunity to benefit from further experiments in China's free trade zone. Considering the deepening of domestic reform and industrial upgrading, exploring the threshold mechanism of responsibility after establishing a high level of negative list, as well as facing environmental protection, labour rules, and competition neutrality, Intellectual property rights and other emerging sensitive issues of legal governance of business responsibility are planned and designed as a whole, which lays a good foundation for the establishment of an influential legal discourse system for foreign investment in China. Of course, the legal system reform of foreign investment in China's free trade zone should not only continuously connect with the high international standards, but also build an indispensable Chinese discourse system for the reform of deep water areas in the light of China's actual situation.
