【摘要】:中國(guó)知識(shí)產(chǎn)權(quán)行政保護(hù),作為中國(guó)知識(shí)產(chǎn)權(quán)保護(hù)“雙軌制”的重要組成部分,自上世紀(jì)八十年代開(kāi)展以來(lái)發(fā)展迅速,取得了舉世矚目的成績(jī),但仍存在不少問(wèn)題。中國(guó)知識(shí)產(chǎn)權(quán)行政保護(hù)立法起點(diǎn)高,直接與國(guó)際標(biāo)準(zhǔn)接軌,但法律法規(guī)尚不統(tǒng)一不完善。各知識(shí)產(chǎn)權(quán)行政保護(hù)機(jī)構(gòu)分散、多元,難以形成合力,行政保護(hù)成本重復(fù)浪費(fèi),溝通不暢效率降低,同時(shí)對(duì)民眾造成困擾。還有地區(qū)發(fā)展不均衡、經(jīng)費(fèi)不足、執(zhí)法力度不嚴(yán)、人才缺乏等問(wèn)題。面對(duì)嚴(yán)峻的國(guó)際挑戰(zhàn)和日趨激烈的國(guó)際競(jìng)爭(zhēng),中國(guó)政府必須采取更為有效的措施,不斷改革完善,努力提高知識(shí)產(chǎn)權(quán)行政保護(hù)水平和效果。 本文對(duì)中國(guó)知識(shí)產(chǎn)權(quán)行政保護(hù)工作在法律依據(jù)、執(zhí)法機(jī)構(gòu)、主要特點(diǎn)及存在問(wèn)題等方面進(jìn)行了分析,通過(guò)借鑒美國(guó)和日本的先進(jìn)經(jīng)驗(yàn),提出了完善改革的對(duì)策建議。中國(guó)知識(shí)產(chǎn)權(quán)行政保護(hù)改革應(yīng)統(tǒng)一各類知識(shí)產(chǎn)權(quán)立法保護(hù)標(biāo)準(zhǔn),合并知識(shí)產(chǎn)權(quán)行政保護(hù)機(jī)構(gòu),弱化糾紛調(diào)處加強(qiáng)行政查處加強(qiáng)行政保護(hù)與司法保護(hù)相銜接,加強(qiáng)執(zhí)法協(xié)作嚴(yán)格依法行政,杜絕部門(mén)利益和地方保護(hù)主義的存在,強(qiáng)化知識(shí)產(chǎn)權(quán)保護(hù)在經(jīng)濟(jì)、社會(huì)政策中的導(dǎo)向作用,加強(qiáng)人才隊(duì)伍建設(shè),,加大政府對(duì)知識(shí)產(chǎn)權(quán)行政保護(hù)經(jīng)費(fèi)的投入。
[Abstract]:Administrative protection of intellectual property rights in China, as an important part of the two-track system of intellectual property protection in China, has developed rapidly since the 1980s, and has made remarkable achievements, but there are still many problems. The legislation of administrative protection of intellectual property rights in China has a high starting point and is directly in line with international standards, but the laws and regulations are still imperfect. The administrative protection institutions of intellectual property rights are scattered, pluralistic, difficult to form a resultant force, the cost of administrative protection is wasted repeatedly, the efficiency of communication is reduced, and at the same time, the people are troubled. There are uneven regional development, inadequate funding, law enforcement is not strict, lack of talent and other problems. In the face of severe international challenges and increasingly fierce international competition, the Chinese government must take more effective measures, constantly reform and perfect, and strive to improve the level and effect of administrative protection of intellectual property rights. This paper analyzes the legal basis, law enforcement agencies, main characteristics and existing problems of the administrative protection of intellectual property rights in China, and puts forward some countermeasures and suggestions to perfect the reform through drawing lessons from the advanced experiences of the United States and Japan. The reform of the administrative protection of intellectual property rights in China should unify the standards for the legislative protection of various types of intellectual property rights, merge the administrative protection agencies of intellectual property rights, and weaken the mediation and handling of disputes, strengthen administrative investigation and handling, strengthen the link between administrative protection and judicial protection. To strengthen law enforcement cooperation and strictly administer according to law, to put an end to the existence of departmental interests and local protectionism, to strengthen the guiding role of intellectual property protection in economic and social policies, and to strengthen the building of a contingent of talented people. Increase government investment in administrative protection of intellectual property rights.
