【摘要】：選取了世界數(shù)字圖書館、歐洲數(shù)字圖書館Europeana等六個(gè)國(guó)外典型的公共數(shù)字文化資源整合項(xiàng)目,通過(guò)網(wǎng)絡(luò)調(diào)研和案例分析等方法,歸納了各項(xiàng)目為平衡著作權(quán)人、資源整合方、終端用戶等各方利益所采取的版權(quán)清理、法律聲明、保護(hù)公有領(lǐng)域、使用創(chuàng)作共用許可協(xié)議、合理利用孤兒作品等知識(shí)產(chǎn)權(quán)策略。并就我國(guó)公共數(shù)字文化資源整合項(xiàng)目如何加強(qiáng)知識(shí)產(chǎn)權(quán)風(fēng)險(xiǎn)控制、有效保障公共利益空間提出了幾點(diǎn)建議。
[Abstract]:This paper selects six typical foreign digital cultural resources integration projects, such as the world digital library and the European digital library Europeana. Through network investigation and case analysis, the author concludes that each project is a balanced copyright owner and a resource integrator.Copyright clearance, legal statements, protection of the public domain, use of creative common license agreements, rational use of orphan works and other intellectual property strategies adopted by end users and other parties.Some suggestions on how to strengthen the risk control of intellectual property rights and ensure the space of public interest are put forward.
