【摘要】：知識(shí)產(chǎn)權(quán)質(zhì)押是知識(shí)產(chǎn)權(quán)運(yùn)用的重要途徑之一，企業(yè)一方面通過(guò)擔(dān)保機(jī)制激活知識(shí)產(chǎn)權(quán)的融資價(jià)值，緩解企業(yè)發(fā)展的資金壓力；另一方面融資所獲資金被投入到企業(yè)創(chuàng)新和知識(shí)產(chǎn)權(quán)的產(chǎn)業(yè)化中，直接發(fā)揮促進(jìn)社會(huì)創(chuàng)新及科技成果轉(zhuǎn)化的功能和作用。從微觀角度而言，企業(yè)與金融機(jī)構(gòu)之間展開(kāi)的知識(shí)產(chǎn)權(quán)質(zhì)押融資活動(dòng)是一種市場(chǎng)主體的自主經(jīng)營(yíng)行為，是市場(chǎng)私主體之間普通的民商事活動(dòng)，法律上是企業(yè)與金融機(jī)構(gòu)之間的債權(quán)債務(wù)法律關(guān)系，但是由于知識(shí)產(chǎn)權(quán)的公共政策屬性、國(guó)家實(shí)施知識(shí)產(chǎn)權(quán)戰(zhàn)略的要求、知識(shí)產(chǎn)權(quán)質(zhì)押融資自身存在的諸多難點(diǎn)，政府基于鼓勵(lì)社會(huì)創(chuàng)新、促進(jìn)知識(shí)產(chǎn)權(quán)運(yùn)用、提升國(guó)家核心競(jìng)爭(zhēng)力的目標(biāo)對(duì)知識(shí)產(chǎn)權(quán)質(zhì)押融資給予政策支持顯得十分必要。實(shí)踐中，國(guó)家及地方政府部門(mén)出臺(tái)了諸多知識(shí)產(chǎn)權(quán)質(zhì)押融資促進(jìn)政策，但我們以實(shí)證分析的方法研究發(fā)現(xiàn)，各地現(xiàn)行的政府促進(jìn)政策在政策目標(biāo)不明確、政策措施的持續(xù)性和規(guī)范性不足等方面存在的問(wèn)題。以近年來(lái)專(zhuān)利權(quán)、商標(biāo)權(quán)的質(zhì)權(quán)登記信息顯示出來(lái)的專(zhuān)利權(quán)、商標(biāo)權(quán)質(zhì)押融資出質(zhì)人、質(zhì)權(quán)人特點(diǎn)為視角，，更能清晰地觀察到，現(xiàn)行諸多的政府促進(jìn)政策在實(shí)踐運(yùn)用中存在不適應(yīng)的地方。如知識(shí)產(chǎn)權(quán)質(zhì)押融資促進(jìn)政策的目標(biāo)和手段存在較大的錯(cuò)位。我們認(rèn)為，應(yīng)從知識(shí)產(chǎn)權(quán)公共屬性的角度出發(fā)定位知識(shí)產(chǎn)權(quán)質(zhì)押融資促進(jìn)政策的目標(biāo)，以平衡政府與市場(chǎng)主體之間的關(guān)系；應(yīng)增強(qiáng)政府促進(jìn)政策的持續(xù)性、全面性和規(guī)范性，政府促進(jìn)政策應(yīng)區(qū)分不同知識(shí)產(chǎn)權(quán)類(lèi)型的適用；另外，政府在加強(qiáng)知識(shí)產(chǎn)權(quán)評(píng)估、推動(dòng)知識(shí)產(chǎn)權(quán)交易市場(chǎng)的建立、知識(shí)產(chǎn)權(quán)融資程序的簡(jiǎn)化、知識(shí)產(chǎn)權(quán)融資機(jī)制的創(chuàng)新等方面提供相應(yīng)的配套措施。
[Abstract]:The pledge of intellectual property rights is one of the important ways to use intellectual property rights. On the one hand, enterprises activate the financing value of intellectual property rights through the guarantee mechanism to alleviate the financial pressure on the development of enterprises.On the other hand, the funds obtained by financing are invested in the industrialization of enterprise innovation and intellectual property rights, which directly play a role in promoting social innovation and the transformation of scientific and technological achievements.From the microcosmic point of view, the financing activity of intellectual property rights pledge between enterprises and financial institutions is a kind of independent management behavior of the market main body, and it is the ordinary civil and commercial activity between the private subjects of the market.Legally, it is the legal relationship between creditor's rights and debts between enterprises and financial institutions. However, due to the public policy attribute of intellectual property, the requirement of the state to implement intellectual property strategy, there are many difficulties in intellectual property pledge financing itself.It is necessary for the government to give policy support to the pledge financing of intellectual property for the purpose of encouraging social innovation, promoting the use of intellectual property rights and promoting the core competitiveness of the country.In practice, the state and local government departments have issued a lot of intellectual property rights pledge financing promotion policies, but we use the empirical analysis method to find that the current government promotion policy in various places in the policy objectives are not clear.The persistence of policy measures and the lack of normative problems.From the point of view of the patent rights, the pledge information of trademark rights registered in recent years, the characteristics of pledge financing and the characteristics of the mortgagee, it can be observed more clearly.Many government promotion policies are not suitable in practice.Such as intellectual property rights pledge financing promotion policy objectives and means of greater dislocation.In our opinion, we should position the goal of IPR pledge financing promotion policy from the perspective of public attribute of intellectual property, in order to balance the relationship between government and market subject, and enhance the sustainability, comprehensiveness and standardization of government promotion policy.Government promotion policies should distinguish between the application of different types of intellectual property rights; in addition, the government is strengthening intellectual property assessment, promoting the establishment of intellectual property trading markets, and simplifying intellectual property financing procedures,The innovation of intellectual property financing mechanism provides corresponding supporting measures.
