【摘要】：“云計算”（Cloud Computing）的概念從2006年第一次提出到現(xiàn)在才短短幾年的時間，其發(fā)展的迅猛程度令人震驚。無論從技術(shù)角度還是應用角度，云計算已經(jīng)成為信息技術(shù)發(fā)展的新旗幟，在這樣的技術(shù)背景之下，我們認為，新技術(shù)的順利產(chǎn)生和良好發(fā)展必將伴隨著相關(guān)知識產(chǎn)權(quán)問題的出現(xiàn)，而云計算商業(yè)方法的專利保護又是其中一個缺乏研究和關(guān)注的知識產(chǎn)權(quán)領(lǐng)域。 云計算商業(yè)方法脫胎于云計算技術(shù)，但是由于云計算本身并沒有所謂技術(shù)創(chuàng)新，而是由現(xiàn)有成熟技術(shù)的整合和管理以求獲得更好的實際效果組成的技術(shù)整合體，其商業(yè)方法在“技術(shù)三性”上也難有突破，所屬技術(shù)領(lǐng)域的限制也使云計算商業(yè)方法在其他領(lǐng)域的使用受到限制，歸于傳統(tǒng)商業(yè)方法也不能通過專利來獲得保護，云計算商業(yè)方法專利保護在我國陷入左右為難之境。 目前我國專利制度對商業(yè)方法尤其是云計算商業(yè)方法設置了重重障礙，可以突破的地方有兩點：第一，將云計算商業(yè)方法歸于采用新技術(shù)手段——計算機和網(wǎng)絡技術(shù)完成的商業(yè)方法，且將其技術(shù)領(lǐng)域限定為“完成該商業(yè)方法的計算機和網(wǎng)絡技術(shù)領(lǐng)域”，這就是說，該申請專利的的云計算商業(yè)方法如果想得到授權(quán)，其在云計算技術(shù)上必須有所突破，以求達到“技術(shù)三性”的要求，并且不能使用在除該技術(shù)以外的其他領(lǐng)域，就目前情況看來，這種“要求”已近乎“苛求”。第二，將云計算商業(yè)方法歸于非技術(shù)性的傳統(tǒng)商業(yè)方法，這從云計算商業(yè)方法的“技術(shù)三性”上來看是符合的，，但是這樣會被審查員以“智力活動的規(guī)則與方法”予以駁回。 本文分析了目前國內(nèi)云計算商業(yè)方法可專利性的現(xiàn)狀和問題，通過文獻調(diào)查、專利實例分析、理論總結(jié)等方法，對云計算商業(yè)方法的專利性問題做了比較全面的研究。文章可以分為四部分：第一部分為引言，論述了研究的背景與意義、國內(nèi)外研究動態(tài)、文章體系內(nèi)容等；第二部分：云計算商業(yè)方法基本概念和理論研究；第三部分：云計算商業(yè)方法可專利性問題研究；第四部分結(jié)論：總結(jié)全文并給出相應的對策。通過論述，作者認為對云計算商業(yè)方法的保護不應當超過國際水平，而是需要根據(jù)我國經(jīng)濟社會的發(fā)展情況制定相應的知識產(chǎn)權(quán)保護制度。
[Abstract]:The concept of "cloud computing" was first introduced in 2006, and it has only been a few years since its rapid development. Cloud computing has become a new banner for the development of information technology, both from a technical point of view and from an application point of view. Against this technological background, we believe that the smooth emergence and good development of new technologies will inevitably accompany the emergence of related intellectual property issues. The patent protection of cloud computing business methods is a lack of research and attention in the field of intellectual property. Cloud computing business method is derived from cloud computing technology, but because cloud computing itself has no so-called technological innovation, it is composed of the integration and management of existing mature technologies in order to obtain better practical results. Its business methods are also difficult to break through in the "three aspects of technology", and the restrictions in its technical field also restrict the use of cloud computing business methods in other fields, and are attributed to the fact that traditional business methods are not protected by patents, Cloud computing business method patent protection in our country into a dilemma. At present, the patent system of our country has set up many obstacles to business methods, especially cloud computing business methods. There are two points that can be broken through: first, Categorizing the business approach of cloud computing as a business approach to the adoption of new technological means, computer and network technology, and limiting its technical field to "the area of computer and network technology that completes the business method", that is, If the patented cloud computing business method is to be licensed, it must make a breakthrough in cloud computing technology in order to meet the requirements of "three technologies" and cannot be used in areas other than that technology, As things stand, this "requirement" is almost "demanding." second, the business approach of cloud computing is classified as a traditional, non-technical business method, which is consistent with the "technological three" nature of the business method of cloud computing. But this would be rejected by the censor as "rules and methods of intellectual activity." This paper analyzes the current situation and problems of patentability of cloud computing business methods in China, through literature investigation, patent case analysis, theoretical summary and so on. The article can be divided into four parts: the first part is the introduction, which discusses the background and significance of the research, the domestic and foreign research trends, the content of the article system, etc. The second part: the basic concept and theory research of cloud computing business method; the third part: research on the patentability of cloud computing business method; the fourth part conclusion: summarize the full text and give the corresponding countermeasure. The author believes that the protection of cloud computing business methods should not exceed the international level, but should be based on the economic and social development of China to formulate the corresponding intellectual property protection system.
