論商業(yè)標識法律保護體系

【摘要】:知識產(chǎn)權(quán)制度來源于西方,我國是從改革開放以來才重視相關(guān)法律的引進與研究,隨著經(jīng)濟的蓬勃發(fā)展,國際貿(mào)易的頻繁,知識產(chǎn)權(quán)的重要性日益凸顯,作為知識產(chǎn)權(quán)重要組成部分的商業(yè)標識權(quán)也越來越受到公眾的重視,商業(yè)標識具有識別性和純粹的財產(chǎn)屬性,凝聚著巨大的無形財產(chǎn)價值,對商業(yè)標識的法律保護往往反映著一個國家經(jīng)濟市場化發(fā)展的程度,以及立法水平。在我國,對商標的法律保護尤為重視,無論從法律法規(guī)上,還是相應的通知及司法解釋上,在經(jīng)濟活動的方方面都對商標有明確的規(guī)定,但是卻對其他商業(yè)標識在法律保護上出現(xiàn)忽略或空白。雖然因為世界貿(mào)易組織對成員國知識產(chǎn)權(quán)領(lǐng)域內(nèi)的法律的硬性要求,迫使我國對相應的商標法進行一定的修改,并制定了其他單行法對相應的商業(yè)標識進行保護,但是單行法對對應的商業(yè)標識的保護都是獨立的,無法體現(xiàn)商業(yè)標志之間在本質(zhì)、功能上的共性和聯(lián)系,又因為制定主體不一樣,導致相關(guān)法律效力等級不同,法律之間的協(xié)調(diào)性不強,必然會產(chǎn)生權(quán)利之間的矛盾與沖突。如何選擇有效的符合本土需求的法律保護模式,對商業(yè)標識進行梳理,化解矛盾與沖突,提高法律的有序性,實現(xiàn)法律的公平價值,是目前商標法修改過程中不可回避的重要問題。目前商業(yè)標識法律保護問題,最關(guān)鍵的就是法律保護模式的選擇,法國采取的是知識產(chǎn)權(quán)法典模式,俄羅斯曾經(jīng)采用過以商標法為基礎(chǔ)的擴充模式,德國制定的足《商標法與其他商業(yè)標識法》,美國依然商標法模式進行保護,我國法律保護模式何去何從,是簡單的法條匯編,還是系統(tǒng)的法律編撰,是單行法獨力解決,還足形成有機體系化法律保護模式這將是我們重點討論的問題。
[Abstract]:The intellectual property system originates from the west. Our country only pays attention to the introduction and research of relevant laws since the reform and opening up. With the vigorous development of economy and the frequent international trade, the importance of intellectual property rights becomes more and more prominent. As an important part of intellectual property rights, the right of commercial logo has been paid more and more attention by the public. The legal protection of commercial signs often reflects the degree of marketization of a country's economy and the level of legislation. In our country, the legal protection of trademarks is particularly important, whether in terms of laws and regulations, corresponding notices and judicial interpretations. There are clear provisions on trademarks on all sides of economic activities, but other commercial logos are ignored or blank in legal protection. Although the World Trade Organization requires the laws of member States in the field of intellectual property rights, Forcing our country to amend the corresponding trademark law to some extent, and make other separate laws to protect the corresponding commercial logo, but the protection of the corresponding commercial mark is independent, which can not reflect the essence of the commercial mark. The commonness and connection in function, and because the subject of the formulation is not the same, resulting in different levels of relevant legal effectiveness, the coordination between the laws is not strong. It is inevitable that there will be contradictions and conflicts between rights. How to choose an effective legal protection mode that meets the local needs, sort out the commercial signs, resolve the contradictions and conflicts, improve the order of the law, and realize the fair value of the law. It is an important issue that cannot be evaded in the process of trademark law revision at present. At present, the choice of legal protection mode is the most crucial issue in the legal protection of commercial logos. France adopts the model of intellectual property code. Russia has adopted an expanded model based on trademark law. Germany has formulated the "Trademark Law and other Commercial marking Law". The United States still protects the trademark law model. Where is our legal protection model going? it is a simple compilation of laws. Or the systematic compilation of laws, is a single law to solve alone, but also enough to form an organic system of legal protection model which will be the focus of our discussion.
