【摘要】：許可裁量權(quán)的濫用及許可實施的機械主義均為行政許可的恣意,并不符合許可正義實施的要求。許可裁量權(quán)的存在及對其功能主義的檢視突破了裁量基準對行政處罰的原初和典型適用,實質(zhì)上多數(shù)情形下許可標準是法律標準與裁量基準的混合。行政許可裁量基準有區(qū)別于其他行政行為裁量基準的法律個性,包括全面公開性要求、類別化的技術(shù)構(gòu)造和直接的對外效力,并且這種特性構(gòu)成了其作為司法審查依據(jù)的基礎(chǔ)。
[Abstract]:The abuse of licensing discretion and the mechanism of licensing are both wanton of administrative licensing and do not meet the requirements of the just implementation of licensing. The existence of licensing discretion and the examination of its functionalism break through the original and typical application of discretion benchmark to administrative punishment. In essence, licensing standard is a mixture of legal standard and discretion benchmark in most cases. Administrative license discretion benchmark is different from other administrative behavior discretion benchmark legal personality, including comprehensive openness requirements, classified technical structure and direct external effect, and this characteristic constitutes the basis of judicial review.
