【摘要】：2013年11月召開的十八屆三中全會上，社會社會保障制度改革成為會議決定的一項重要內(nèi)容。建立公平的社會保障制度是以后工作的重點。社會保障制度起源于工業(yè)化和現(xiàn)代化完成較早的西方發(fā)達國家，對西方發(fā)達國家的經(jīng)濟發(fā)展和社會穩(wěn)定都起過重要的作用。在我國，要想建立和健全社會主義市場經(jīng)濟，維護社會的和諧穩(wěn)定，建立起社會主義和諧社會，那么一個健全的社會保障制度必不可少。社會保障制度在當前之于個人和社會都發(fā)揮著重要的作用。完善的社會保障制度的建立需要有法律強有力的保障，完善社會保障法律是我國今后立法工作的一項重點。雖然我國的社會保障法律的建設在當前已經(jīng)有了長足的進步，但仍然存在很多問題，比如社會保障法律不健全、社會保障法律效力過低、社會保障法律的執(zhí)行缺乏必要的強制力、社會保障覆蓋的人群較窄等。解決問題，一方面要立足于我國的實際，從我國的國情出發(fā)，探索出一條適合我國實際的社會保障法律建設之路，另一方面要汲取人類文明的發(fā)展成果，借鑒其他國家的先進經(jīng)驗，取長補短。文章主要分為四大部分，第一部分介紹了社會保障的基本理論，第二部分著重分析了我國當前社會保障立法的現(xiàn)狀以及存在的主要問題，第三部分通過分析其他國家的社會保障法律，來為我國建設社會保障法律制度提供橫向的參考，第四部分主要介紹了完善我國社會保障法律制度，有宏觀的立法原則，，也有微觀的具體措施。
[Abstract]:At the third Plenary session of the 18th CPC Central Committee in November 2013, the reform of social security system became an important part of the meeting. The establishment of a fair social security system is the focus of future work. The social security system originated from the western developed countries, which finished industrialization and modernization earlier, and played an important role in the economic development and social stability of the western developed countries. In order to establish and perfect the socialist market economy, maintain the social harmony and stability, and establish the socialist harmonious society, a sound social security system is essential in our country. The social security system plays an important role in both individuals and society at present. The establishment of a perfect social security system requires strong legal protection, and perfecting the social security law is an important part of our country's legislative work in the future. Although the construction of social security laws in our country has made considerable progress at present, there are still many problems, such as the imperfection of social security laws and the low effectiveness of social security laws. The enforcement of social security law lacks the necessary force, and the population covered by social security is narrower. To solve the problem, we should, on the one hand, base ourselves on the reality of our country, proceed from our national conditions, and explore a road to the construction of social security laws suitable for the actual situation of our country; on the other hand, we should draw on the fruits of the development of human civilization. Learn from the advanced experience of other countries, learn from each other. The article is divided into four parts. The first part introduces the basic theory of social security, the second part focuses on the analysis of the current situation of social security legislation and the main problems. The third part provides the horizontal reference for the construction of the social security legal system by analyzing the social security laws of other countries. The fourth part mainly introduces how to perfect the social security legal system of our country and has the macroscopic legislative principles. There are also micro-specific measures.
