【摘要】：弗格森槍擊案反映出美國對警察權(quán)益保護較為全面,而我國警察防衛(wèi)權(quán)尚處于理論研究階段。暴恐事件頻發(fā)的背景下暴露出我國警察使用槍支進行防衛(wèi)還存在法律與實踐上的諸多問題,我國混亂的警察防衛(wèi)現(xiàn)狀的根本原因就在于警察防衛(wèi)權(quán)理論的缺位。本文通過對國外關(guān)于警察防衛(wèi)權(quán)相關(guān)立法進行對比研究,剖析我國警察防衛(wèi)權(quán)理論存在的問題,總結(jié)借鑒國外先進的理論及經(jīng)驗并根據(jù)我國的立法實踐以矯正我國警察防衛(wèi)權(quán)理念歸屬,從警察防衛(wèi)權(quán)的具體架構(gòu)方面對我國警察防衛(wèi)權(quán)的建立進行詳細探討。
[Abstract]:The Ferguson shooting case reflects the comprehensive protection of police rights and interests in the United States, while the police defense right in our country is still in the theoretical research stage. Against the background of frequent incidents of violence and terrorism, there are still many problems in law and practice in China's police using guns to defend themselves. The fundamental reason for the chaotic situation of police defense in our country lies in the absence of the theory of police defense right. Through the comparative study on the relevant legislation of the police defense right abroad, this paper analyzes the problems existing in the theory of the police defense right in our country. This paper summarizes and draws lessons from the advanced theories and experiences of foreign countries and corrects the concept of police defense right according to the legislative practice of our country, and discusses in detail the establishment of the police defense right in China from the specific structure of the police defense right.
