公證機(jī)構(gòu)質(zhì)量管理制度研究

【摘要】:國家正在對(duì)事業(yè)單位進(jìn)行新一輪的改革,自從公證機(jī)構(gòu)由國家行政機(jī)關(guān)改制為事業(yè)單位之后,每一次的事業(yè)單位改革便都為公證機(jī)構(gòu)的制度建設(shè)打上深深的烙印。本文即是在事業(yè)單位改革之際,探討公證機(jī)構(gòu)質(zhì)量管理制度的建立。本文選用法律的視角對(duì)公證質(zhì)量及公證機(jī)構(gòu)質(zhì)量管理中存在的問題進(jìn)行透析,旨在以這些法律問題為導(dǎo)向,借助于對(duì)質(zhì)量管理學(xué)的經(jīng)驗(yàn)借鑒,對(duì)我國公證機(jī)構(gòu)質(zhì)量管理制度的建構(gòu)進(jìn)行有益的思考。鑒于本文論證的需要,筆者選取了文獻(xiàn)研究法、實(shí)證分析法和綜合分析法等多種研究方法。 本文共分為四個(gè)部分,第一部分是對(duì)公證機(jī)構(gòu)質(zhì)量管理制度的一般考察,,在這一部分中,首先明確了公證質(zhì)量的內(nèi)涵和外延,并對(duì)選用“公證質(zhì)量管理”這一表述的原因進(jìn)行闡述,重點(diǎn)在于相似概念的辨析。然后對(duì)我國公證機(jī)構(gòu)質(zhì)量管理制度的法律依據(jù)和實(shí)務(wù)中的制度運(yùn)行進(jìn)行了梳理。第二部分論述了公證質(zhì)量和公證機(jī)構(gòu)質(zhì)量管理中存在的主要問題。第三部分指出了引發(fā)當(dāng)前公證機(jī)構(gòu)的公證質(zhì)量問題及其質(zhì)量管理問題的原因,主要包括:對(duì)構(gòu)建公證機(jī)構(gòu)質(zhì)量管理制度的原則缺乏關(guān)注、公證質(zhì)量標(biāo)準(zhǔn)缺失、公證機(jī)構(gòu)質(zhì)量管理制度的法律依據(jù)不完善和公證機(jī)構(gòu)質(zhì)量管理制度中缺乏保障機(jī)制。第四部分探討了公證機(jī)構(gòu)質(zhì)量管理制度的構(gòu)建。該部分首先探討了構(gòu)建公證機(jī)構(gòu)質(zhì)量管理制度的原則,其次明確了公證質(zhì)量標(biāo)準(zhǔn),最后對(duì)公證機(jī)構(gòu)質(zhì)量管理當(dāng)中的法律依據(jù)的完善、公證質(zhì)量管理機(jī)構(gòu)的建立、公證質(zhì)量管理中的資源管理、公證信息平臺(tái)建設(shè)和公證員執(zhí)業(yè)保證金制度建設(shè)進(jìn)行了探討,并得出公證機(jī)構(gòu)應(yīng)把握事業(yè)單位改革這一契機(jī)構(gòu)建公證質(zhì)量管理制度的結(jié)論。
[Abstract]:The country is carrying on a new round of reform to the public institution. Since the notarization organization was changed from the state administrative organ to the institution, every reform of the institution has made a deep imprint on the system construction of the notary institution. This paper discusses the establishment of the quality management system of notary institutions during the reform of public institutions. This article selects the legal angle of view to carry on the dialysis to the notarization quality and the notarization organization quality management question, in order to take these legal questions as the guidance, with the aid of the experience of the quality management, The construction of quality management system of notary institutions in China is considered. In view of the need of this paper, the author chooses the literature research method, the empirical analysis method and the comprehensive analysis method and so on. The thesis is divided into four parts, the first part is the general investigation of the notarial organization quality management system. In this part, the connotation and extension of notarization quality are clarified, and the reasons for the choice of "notarization quality management" are expounded, with emphasis on the discrimination of similar concepts. Then the legal basis and the system operation of the quality management system of notary institutions in our country are combed. The second part discusses the main problems of notarization quality and notarization organization quality management. The third part points out the problems of notarization quality and its quality management problems, including the lack of attention to the principles of establishing the quality management system of notaries, the lack of standards of notarization quality. The legal basis of the quality management system of notaries is not perfect and the guarantee mechanism is lacking in the quality management system of notaries. The fourth part discusses the construction of the quality management system of notary institutions. This part first discusses the principles of establishing the quality management system of notarization organizations, then clarifies the standards of notarization quality, and finally improves the legal basis in the quality management of notaries, and establishes the notarial quality management agencies. This paper probes into the resource management, the construction of notarization information platform and the construction of the system of notarization guarantee in the management of notarization quality, and draws the conclusion that the notary institution should grasp the opportunity of reforming the institution to construct the system of notarization quality management.
