【摘要】：失業(yè)是市場經濟條件下產生的一種社會現象,自19世紀末開始,西方主要資本主義國家開始著手涉及失業(yè)保險法律制度的構建,迄今為止,世界上已有四十多個國家和地區(qū)建立了失業(yè)保險制度,同時越來越多的國家也從保障失業(yè)者基本生活所需,轉向重視失業(yè)保險的預防失業(yè)和促進就業(yè)職能。我國的失業(yè)保險制度起步較晚,隨著我國改革開放的不斷深入,失業(yè)問題不斷涌現,1999年《失業(yè)保險條例》實施,失業(yè)保險制度成為社會與法治領域關注的熱點話題。經過近十年的發(fā)展,2010年我國《社會保險法》以專章立法的形式對我國失業(yè)保險法律制度進行了完整的闡釋,完善了失業(yè)保險制度的法律體系,促進了我國社會保障制度的發(fā)展。本文第一部分介紹了失業(yè)保險法律制度的基本理論,通過對失業(yè)及其相關概念的闡釋,為后文展開論述奠定基礎。第二部分對我國及國外法治發(fā)達國家,如英、美、德、日等國的相關失業(yè)保險法律制度進行分析,為我國失業(yè)保險法律制度的完善提供了啟示。第三部分對我國失業(yè)保險法律制度中存在的一系列問題,展開了詳盡分析,找出問題的根源,為后文提出解決問題的措施提供相關建議。第四部分針對我國失業(yè)保險法律制度中存在的問題提出了解決方案,比如在失業(yè)保險領域中關于失業(yè)、非自愿性失業(yè)、再就業(yè)意愿等基礎概念的界定問題以及促進再就業(yè)、保險基金的籌集、《社會保險法》的完善建議等等,作出了詳細的闡釋,并結合我國實際國情提出了相關的立法建議。
[Abstract]:Unemployment is a kind of social phenomenon under the condition of market economy. Since the end of the 19th century, the main capitalist countries in the West have begun to involve the construction of the legal system of unemployment insurance. More than 40 countries and regions in the world have established unemployment insurance system. At the same time, more and more countries have shifted from guaranteeing the basic needs of the unemployed to paying attention to the functions of unemployment prevention and employment promotion. The unemployment insurance system of our country starts late. With the deepening of reform and opening up in our country, the unemployment problem emerges constantly. In 1999, the "unemployment Insurance regulations" came into effect, and the unemployment insurance system has become a hot topic in the field of society and the rule of law. After nearly ten years of development, in 2010, the Social Insurance Law of our country made a complete explanation of the legal system of unemployment insurance in the form of special legislation, perfected the legal system of unemployment insurance system, and promoted the development of social security system in China. The first part of this paper introduces the basic theory of the legal system of unemployment insurance, through the explanation of unemployment and its related concepts, it lays a foundation for the later discussion. The second part analyzes the relevant legal systems of unemployment insurance in China and other developed countries, such as Britain, America, Germany, Japan and so on, and provides enlightenment for the perfection of the legal system of unemployment insurance in China. In the third part, a series of problems existing in the legal system of unemployment insurance in China are analyzed in detail to find out the root causes of the problems, and to provide relevant suggestions for the measures to solve the problems later. The fourth part puts forward solutions to the problems existing in the legal system of unemployment insurance in China, such as defining the basic concepts of unemployment, involuntary unemployment, re-employment willingness and promoting re-employment in the field of unemployment insurance. The raising of insurance fund, the perfect suggestion of Social Insurance Law and so on, are explained in detail, and the relevant legislative suggestions are put forward according to the actual situation of our country.
