論我國(guó)政府信息公開制度存在的問(wèn)題與改進(jìn)途徑

【摘要】:信息在現(xiàn)代社會(huì)生產(chǎn)生活中具有基礎(chǔ)的原動(dòng)力作用,很大程度上決定了一個(gè)社會(huì)的發(fā)展和進(jìn)步,而公民如何獲取信息、如何使用信息則充分表現(xiàn)出一個(gè)國(guó)家的現(xiàn)代化水平和國(guó)家治理追平。世界上率先建立信息公開制度的是瑞典,該國(guó)在1776年頒布的《公文書公開法》是世界上第一部成文的政府信息公開法律。以二十世紀(jì)經(jīng)濟(jì)危機(jī)和第二次世界大戰(zhàn)爆發(fā)為第一個(gè)立法高潮,二十世紀(jì)九十年代隨著信息技術(shù)和世界貿(mào)易的進(jìn)一步發(fā)展,信息公開立法迎來(lái)了第二個(gè)高潮。我國(guó)的政府公開是隨著我國(guó)改革開放逐漸發(fā)展起來(lái)的,到2008年5月1日開始實(shí)施我國(guó)的第一部成文的政府信息公開類法規(guī)—《中華人民共和國(guó)政府信息公開條例》。到現(xiàn)在,《條例》的實(shí)施已經(jīng)有超過(guò)8年的時(shí)間,為我國(guó)的信息公開工作帶來(lái)了巨大的推動(dòng)作用,但是也發(fā)現(xiàn)了一些問(wèn)題,比如:《條例》立法層級(jí)不高、規(guī)定不明確等,導(dǎo)致各個(gè)地方在理解和執(zhí)行《條例》的過(guò)程中存在較大的差異,因此很難有效落實(shí)信息公開制度,進(jìn)而保障公民的知情權(quán)。因此,本文從《條例》出發(fā)點(diǎn),探討現(xiàn)行制度存在的問(wèn)題和可能采取的改進(jìn)措施具有明顯的現(xiàn)實(shí)意義。筆者從信息公開立法實(shí)際和自身工作的實(shí)際出發(fā),從四個(gè)方面來(lái)探討進(jìn)一步完善我國(guó)信息公開制度建設(shè)的建議。第一部分從行政性、準(zhǔn)確性和有限性三個(gè)方面介紹政府信息的概念,從而確定本文的研究對(duì)象問(wèn)題,同時(shí)進(jìn)一步闡述信息公開制度的理論淵源:人民主權(quán)理論和知情權(quán)理論,使得本文的研究有理有據(jù);第二部分論述建立和完善政府信息公開制度的意義,進(jìn)一步揭示本文研究所具有的的現(xiàn)實(shí)意義以及緊迫性;第三部分從立法層面、規(guī)定本身以及監(jiān)督機(jī)制等方面對(duì)現(xiàn)行《條例》存在的問(wèn)題進(jìn)行深入剖析,為下一步提出完善建議指明方向;最后一部分提出完善我國(guó)信息公開制度的合理化建議,通過(guò)制定統(tǒng)一的《信息公開法》,明確信息公開的制度、內(nèi)容和監(jiān)管機(jī)制,使該項(xiàng)制度真正發(fā)揮應(yīng)有的作用。
[Abstract]:Information plays a fundamental role in the production and life of modern society, and to a great extent determines the development and progress of a society, and how citizens obtain information. How to use information will fully show a country's modernization level and national governance level. Sweden is the first country to set up the open information system in the world. The publication of official documents Act issued by Sweden in 1776 is the first written government information disclosure law in the world. The first legislative climax was the outbreak of the economic crisis in the 20th century and the outbreak of the second World War. With the further development of information technology and world trade in the 1990s, the information disclosure legislation ushered in the second climax. With the gradual development of our country's reform and opening up, the first written government information disclosure regulation of the people's Republic of China (PRC) has been implemented since May 1, 2008. Up to now, the implementation of the regulations has been carried out for more than eight years, which has brought great impetus to the work of information disclosure in our country. However, it has also found some problems, such as: the legislative level is not high, the regulations are not clear, and so on. As a result, there are great differences in the process of understanding and implementing "regulations" in various places, so it is very difficult to effectively implement the information disclosure system, and then to protect the citizens' right to know. Therefore, from the point of view of "regulations", it is of great practical significance to discuss the problems existing in the current system and the possible improvement measures. Based on the practice of information publicity legislation and its own work, the author discusses the suggestions for further improving the construction of information disclosure system in China from four aspects. The first part introduces the concept of government information from three aspects of administration, accuracy and finiteness, so as to determine the research object of this paper. At the same time, it further expounds the theoretical origin of the information disclosure system: the theory of people's sovereignty and the theory of the right to know. The second part discusses the significance of establishing and perfecting the system of government information disclosure, and further reveals the practical significance and urgency of this study; the third part from the legislative level, The provisions themselves and the supervision mechanism thoroughly analyze the problems existing in the current regulations, and point out the direction for further improvement. The last part puts forward the rationalization proposals to improve the information disclosure system in our country. The system, content and supervision mechanism of information disclosure should be made clear by making a unified Law on Information publicity, so that the system can really play its due role.
