【摘要】:本文中的中小學(xué)校園安全管理聯(lián)動(dòng)指的就是政府內(nèi)部各個(gè)部門(mén)為了成功應(yīng)對(duì)中小學(xué)校園安全管理中出現(xiàn)的各種各樣的問(wèn)題,采取共同制定規(guī)劃,相互配合,共同采取行動(dòng),從而更好的解決中小學(xué)校園安全問(wèn)題。中小學(xué)校園安全管理聯(lián)動(dòng)法律保障則是指通過(guò)法律手段保障中小學(xué)校園安全管理聯(lián)動(dòng)的順利運(yùn)行。 本研究以強(qiáng)化政府各部門(mén)責(zé)任,,最大限度的避免和減少中小學(xué)校園安全事故的發(fā)生,切實(shí)保障中小學(xué)生的健康成長(zhǎng)為主線,在廣泛調(diào)查并剖析具體案例的基礎(chǔ)上,深層次的探尋我國(guó)中小學(xué)校園安全存在問(wèn)題的社會(huì)根源;通過(guò)角色定位、責(zé)任與制度分析,對(duì)中小學(xué)校園安全管理聯(lián)動(dòng)法律保障的必要性及現(xiàn)實(shí)困境進(jìn)行深入的思考;通過(guò)對(duì)現(xiàn)有法律規(guī)定的梳理、現(xiàn)行制度的分析找出法律規(guī)制與制度完善的缺失與不足;在借鑒國(guó)外經(jīng)驗(yàn)的基礎(chǔ)上,提出中小學(xué)校園安全管理聯(lián)動(dòng)法律保障工作應(yīng)遵循的原則、具體策略及運(yùn)行保障措施。 第一部分,中小學(xué)校園安全管理聯(lián)動(dòng)法律保障的概念分析及理論述要。首先對(duì)校園安全管理聯(lián)動(dòng)概念及特征進(jìn)行分析,科學(xué)界定校園安全管理聯(lián)動(dòng)的內(nèi)涵;其次是探討建立中小學(xué)校園安全管理聯(lián)動(dòng)法律保障的理論依據(jù);分析中小學(xué)校園安全管理聯(lián)動(dòng)的基礎(chǔ)關(guān)系即權(quán)責(zé)分析和內(nèi)部關(guān)系分析;提出完善中小學(xué)校園安全社會(huì)聯(lián)動(dòng)法律保障應(yīng)遵循的原則。 第二部分,中小學(xué)小學(xué)校園安全管理聯(lián)動(dòng)的現(xiàn)實(shí)必要性以及法律保障現(xiàn)狀。首先,列舉中小學(xué)校園安全管理聯(lián)動(dòng)法律保障的現(xiàn)實(shí)依據(jù)。其次,對(duì)我國(guó)中小學(xué)校園安全管理聯(lián)動(dòng)的現(xiàn)實(shí)狀況進(jìn)行總結(jié)。 第三部分,中小學(xué)校園安全管理聯(lián)動(dòng)法律保障存在的問(wèn)題及原因分析。從立法、執(zhí)法、監(jiān)督等方面對(duì)中小學(xué)校園安全管理聯(lián)動(dòng)法律保障存在的問(wèn)題進(jìn)行總結(jié);其次,分析這些問(wèn)題的原因。 第四部分,中小學(xué)校園安全管理聯(lián)動(dòng)法律保障的完善。以美國(guó)、英國(guó)等國(guó)外典型的校園安全管理聯(lián)動(dòng)為例,對(duì)基于不同政治體制、經(jīng)濟(jì)水平和社會(huì)發(fā)展背景而建立的校園安全社會(huì)聯(lián)動(dòng)進(jìn)行系統(tǒng)分析和比較,探尋其對(duì)我國(guó)的有益啟示。我國(guó)中小學(xué)校園安全管理聯(lián)動(dòng)法律保障的完善。根據(jù)我國(guó)目前的國(guó)情,從完善法律制度、執(zhí)法體系、責(zé)任追究等方面提出完善中小學(xué)校園安全社會(huì)聯(lián)動(dòng)法律保障的具體策略。
[Abstract]:In this paper, the safety management of primary and secondary school is the linkage of the various departments within the government in order to successfully deal with all kinds of problems in the safety management of primary and secondary school, and adopt joint formulation and planning, cooperate with each other, take action together, so as to better solve the problem of campus safety in primary and secondary schools. Legal protection means the smooth operation of primary and secondary school safety management linkage through legal means.
In order to strengthen the responsibility of various departments of the government, to avoid and reduce the safety accidents of primary and secondary school, and to ensure the healthy growth of primary and middle school students as the main line, on the basis of extensive investigation and analysis of specific cases, we deeply explore the social root of the problem of the existence of the garden security in primary and secondary schools in our country; through role positioning, The analysis of responsibility and system, the necessity and realistic predicament of the security management of primary and secondary schools, through the analysis of the existing laws and regulations, the analysis of the current system to find out the deficiencies and deficiencies of the legal regulation and system improvement; on the basis of the experience of foreign countries, the campus safety management of primary and secondary schools is proposed. The principles, specific strategies and operational safeguards for the legal linkage protection work should be followed.
The first part, the concept analysis and the theory of the security management linkage of primary and secondary school. First, it analyzes the concept and characteristics of the linkage of campus safety management, defines the connotation of the linkage of campus safety management scientifically; secondly, discusses the theoretical basis for establishing the legal guarantee of the campus safety management of primary and secondary schools, and analyses the primary and secondary schools. The basic relationship of the linkage of campus safety management is the analysis of power and responsibility and the analysis of internal relations, and puts forward the principles that should be followed to improve the social linkage of the school safety in primary and secondary schools.
The second part, primary and secondary school campus safety management linkage practical necessity and legal protection status. First, enumerate the practical basis of the security management of primary and secondary schools. Secondly, summarize the actual situation of the linkage of safety management in primary and secondary schools in our country.
The third part, the existing problems and reasons analysis of the security management of primary and secondary school campus security. From the legislation, law enforcement, supervision and other aspects of the security management of primary and secondary school campus security management linkage legal protection problems are summarized; secondly, the reasons for the analysis of these problems.
The fourth part, the improvement of the security management of primary and secondary school campus security. Taking the United States, Britain and other typical foreign campus security management linkage as an example, this paper analyzes and compares the social linkage of campus safety based on different political system, economic level and social development background, exploring its beneficial enlightenment to our country. In accordance with the current national conditions of our country, the concrete strategies of perfecting the legal guarantee of the social linkage of the campus safety in primary and secondary schools are put forward in accordance with the current national conditions of our country.
