【摘要】：本文主要分五部分展開闡述,第一部分是緒論部分,主要概括了本課題研究的目的、意義以及相關(guān)研究現(xiàn)狀,為全文研究做好鋪墊。第二部分主要對(duì)交通執(zhí)法自由裁量權(quán)進(jìn)行理論分析,涵蓋交通執(zhí)法自由裁量權(quán)的涵義及分類、行使原則等多個(gè)方面。第三部分,對(duì)交通執(zhí)法自由裁量權(quán)行使的現(xiàn)狀進(jìn)行論述,綜述我國交通執(zhí)法自由裁量權(quán)失范的表現(xiàn),找出交通執(zhí)法自由裁量權(quán)失范的原因,驗(yàn)證規(guī)范交通執(zhí)法行政自由裁量權(quán)必要性。第四部分,通過回顧分析英美法系國家、大陸法系國家對(duì)交通行政自由裁量權(quán)的經(jīng)驗(yàn),汲取國外交通執(zhí)法自由裁量權(quán)先進(jìn)經(jīng)驗(yàn),以推動(dòng)我國交通執(zhí)法自由裁量權(quán)的改進(jìn)。第五部分,在以上基礎(chǔ)上提出交通執(zhí)法自由裁量權(quán)的規(guī)制措施,包括立法上制定交通執(zhí)法自由裁量標(biāo)準(zhǔn),加強(qiáng)交通執(zhí)法自由裁量權(quán)的程序控制,建立完善的交通執(zhí)法監(jiān)督機(jī)制等內(nèi)容。
[Abstract]:This paper is mainly divided into five parts, the first part is the introduction part, which summarizes the purpose, significance and related research status of this research, and makes a good foundation for the full text research. The second part mainly carries on the theory analysis to the traffic law enforcement discretion, including the traffic law enforcement discretion the meaning and the classification, the exercise principle and so on many aspects. The third part, discusses the present situation of the traffic law enforcement discretion, summarizes the performance of the traffic law enforcement discretion, finds out the reasons of the traffic law enforcement discretion. To verify the necessity of standardizing the administrative discretion of traffic law enforcement. The fourth part, through reviewing and analyzing the experience of the countries of Anglo-American law system and civil law system on the traffic administrative discretion, drawing on the advanced experience of foreign traffic law enforcement discretion, in order to promote the improvement of the traffic law enforcement discretion in our country. The fifth part, on the basis of the above, put forward the regulation measures of traffic law enforcement discretion, including legislation to formulate the traffic law enforcement discretion standards, strengthen the traffic law enforcement discretion procedural control. Establish perfect traffic law enforcement supervision mechanism and so on.
