【摘要】：近些年,媒體中經(jīng)�？梢姽矙C(jī)關(guān)查禁賣淫嫖娼活動(dòng)的現(xiàn)場報(bào)道及公眾人物因賣淫嫖娼被處罰的報(bào)道。關(guān)于這種報(bào)道是否合法、是否合理,存在著不小的爭議。文章首先從幾個(gè)典型的案例引入,探討公安機(jī)關(guān)以傳統(tǒng)媒體或自媒體為媒介,將涉及個(gè)人信息的賣淫嫖娼違法信息向社會(huì)披露的行為的性質(zhì),得出其不合法、不合理且缺乏必要性的結(jié)論。接下來從我國法制傳統(tǒng)及公安機(jī)關(guān)、媒體的管理和運(yùn)行現(xiàn)狀等方面進(jìn)行分析,探究公安機(jī)關(guān)及媒體將該種信息向社會(huì)進(jìn)行披露的原因。最后,嘗試提出一種切實(shí)可行的制度架構(gòu),通過對披露范圍和披露程序的嚴(yán)格限制,以期達(dá)到保護(hù)賣淫嫖娼違法者合法權(quán)益的目的。
[Abstract]:In recent years, the public security organs often see the suppression of prostitution reports and public figures for prostitution punishment reports. There is a great deal of controversy about whether such reports are legal and reasonable. First of all, from several typical cases, the article discusses the nature of the public security organ's behavior of disclosing the illegal information of prostitution and whoring involving personal information to the society by using the traditional media or the self-media as the media, and draws its conclusion that it is illegal. A conclusion that is unreasonable and lacks necessity. Then from the aspects of the legal tradition of our country and the public security organs, the management and operation of the media, this paper analyzes the reasons why the public security organs and the media disclose this kind of information to the society. Finally, a practical institutional framework is proposed to protect the legitimate rights and interests of prostitutes by strictly limiting the scope of disclosure and disclosure procedures.
