遼寧省機(jī)動(dòng)車交通事故社會(huì)救助基金補(bǔ)償程序問題研究

【摘要】:機(jī)動(dòng)車交通事故社會(huì)救助基金是國家設(shè)立的,用于搶救在機(jī)動(dòng)車交通事故的交通事故受害人而先行墊付的資金,是一項(xiàng)重要的社會(huì)救助制度,已在一些國家或地區(qū)開始實(shí)施。作為社會(huì)救助的一種新形式,機(jī)動(dòng)車交通事故社會(huì)救助基金制度的設(shè)立,對(duì)保障機(jī)動(dòng)車交通事故受害人權(quán)益、分擔(dān)交通事故風(fēng)險(xiǎn)、促進(jìn)社會(huì)和諧起到了積極的推動(dòng)作用。然而,令人遺憾的是機(jī)動(dòng)車交通事故社會(huì)救助基金制度在我國還沒有廣泛施行,有待于進(jìn)一步的普及與提高。我國第一次提出機(jī)動(dòng)車交通事故救助基金制度的概念,是《中華人民共和國道路交通安全法》(以下簡稱《道路交通安全法》)頒布實(shí)施,從該概念的確立到現(xiàn)在已將近11年,然而實(shí)踐的情況是除少數(shù)省、市已有部分機(jī)動(dòng)車交通事故交通事故受害人獲得救助基金救濟(jì)外,包括北京市、遼寧省在內(nèi)的大多數(shù)地區(qū),基金救助工作尚未完全展開。我所在的遼寧省雖然在各方面的努力之下,,于2014年啟動(dòng)了機(jī)動(dòng)車交通事故救助基金,但在機(jī)動(dòng)車交通事故社會(huì)救助基金救助程序方面的現(xiàn)實(shí)操作中缺管明確具體的規(guī)定,導(dǎo)致一方面大多數(shù)的救助基金剩余,另一方面相當(dāng)數(shù)量的機(jī)動(dòng)車交通事故當(dāng)事人無法得到有效救助,二者出現(xiàn)矛盾,導(dǎo)致大多數(shù)救助基金仍然在“沉睡”中,遠(yuǎn)未發(fā)揮其應(yīng)有之功用。目前,我所在的遼寧省法庫縣人民法院至今未受理一起關(guān)于機(jī)動(dòng)車交通事故社會(huì)救助基金的訴訟,當(dāng)?shù)刂两褚参丛O(shè)立救助基金管理部門。造成這個(gè)現(xiàn)象的重要原因是,法律對(duì)救助基金補(bǔ)償程序的規(guī)定過于原則而缺乏可操作性,F(xiàn)行規(guī)定對(duì)補(bǔ)償程序的啟動(dòng)主體、審核主體沒有明確的具體規(guī)定,特別是管理機(jī)構(gòu)審核程序,交通事故受害人與基金管理機(jī)構(gòu)發(fā)生爭議的解決機(jī)制,交通事故受害人的救助途徑、對(duì)救助基金管理機(jī)構(gòu)及基金管理人的監(jiān)督等方面的規(guī)定過于籠統(tǒng),致使救助基金補(bǔ)償程序在現(xiàn)實(shí)操作中存在諸多問題。這便制約了救助基金制度充分發(fā)揮應(yīng)有之功能,無法有效保護(hù)交通事故交通事故受害人的利益。本文擬從遼寧省機(jī)動(dòng)車交通事故社會(huì)救助基金制度的實(shí)施現(xiàn)狀出發(fā),借鑒各省市在補(bǔ)償程序方面的規(guī)定,參考其他國家和地區(qū)的先進(jìn)經(jīng)驗(yàn),以此為基礎(chǔ),提出完善遼寧省道路機(jī)動(dòng)車交通事故社會(huì)救助基金補(bǔ)償程序的整體思路,探索出救助基金制度的相關(guān)措施和意見,以便能引起業(yè)界同仁的關(guān)注,并促成該補(bǔ)償程序的付諸實(shí)施,發(fā)揮機(jī)動(dòng)車交通事故社會(huì)救助基金應(yīng)有之功用。
[Abstract]:The motor vehicle traffic accident social assistance fund is established by the state, which is used to rescue the traffic accident victims in the motor vehicle traffic accident and advance the funds, is an important social assistance system, has been implemented in some countries or regions. As a new form of social assistance, the establishment of social assistance fund system for motor vehicle traffic accidents has played a positive role in protecting the rights and interests of the victims of motor vehicle traffic accidents, sharing the risks of traffic accidents and promoting social harmony. However, it is regrettable that the social assistance fund system for motor vehicle traffic accidents has not been widely implemented in China, and needs to be further popularized and improved. The concept of the motor vehicle traffic accident relief fund system was first put forward in China, which was promulgated and implemented by the Road Traffic Safety Law of the people's Republic of China (hereinafter referred to as the Road Traffic Safety Law). It has been nearly 11 years since the concept was established. However, in practice, except for a few provinces and cities, some of the victims of motor vehicle traffic accidents have received relief from the relief fund. In most areas, including Beijing and Liaoning Province, the relief work of the fund has not been carried out completely. Although Liaoning Province, where I live, started the motor vehicle traffic accident rescue fund in 2014, it lacks clear and specific regulations in the practical operation of the social assistance fund for motor vehicle traffic accidents. On the one hand, most of the rescue funds are surplus; on the other hand, a considerable number of the parties involved in motor vehicle traffic accidents are unable to get effective relief, and there are contradictions between the two, leading to the majority of the rescue funds still "sleeping". Far from performing its proper function. At present, the people's Court of Faku County in Liaoning Province has not accepted a lawsuit concerning the social relief fund for motor vehicle traffic accidents, and the local government has not set up a rescue fund management department. The main reason for this phenomenon is that the legal provisions on the salvage fund compensation procedure are too principled and lack of maneuverability. The current regulations have no specific provisions on the subject of the initiation of the compensation procedure, the subject of the audit, especially the audit procedure of the management body, the mechanism for resolving disputes between the victims of traffic accidents and the fund management organization, The relief ways for the victims of traffic accidents and the supervision of the fund management agencies and fund managers are too general, resulting in many problems in the practical operation of the relief fund compensation procedure. This restricts the rescue fund system to give full play to its proper function and can not effectively protect the interests of traffic accident victims. This paper intends to proceed from the present situation of the implementation of the social relief fund system for motor vehicle traffic accidents in Liaoning Province, draw lessons from the provisions of the compensation procedures of provinces and cities, and refer to the advanced experiences of other countries and regions, and take this as the basis. This paper puts forward the whole idea of perfecting the compensation procedure of the social relief fund for road motor vehicle traffic accident in Liaoning Province, and explores the relevant measures and opinions of the rescue fund system, so as to arouse the attention of the industry colleagues, and to promote the implementation of the compensation procedure. Give full play to the functions of the social assistance fund for motor vehicle traffic accidents.
