【摘要】：[目的/意義]在實(shí)施國(guó)家大數(shù)據(jù)的戰(zhàn)略背景下,我國(guó)大數(shù)據(jù)交易剛起步就顯示出迅猛發(fā)展的勢(shì)頭,但因并未形成規(guī)范的交易規(guī)則以及大數(shù)據(jù)交易內(nèi)在的交易風(fēng)險(xiǎn),愈發(fā)顯示出法律監(jiān)管的必要性。[方法/過程]在分析我國(guó)大數(shù)據(jù)交易的實(shí)踐情況和大數(shù)據(jù)交易平臺(tái)交易規(guī)則的基礎(chǔ)上,認(rèn)為大數(shù)據(jù)交易中的買方和賣方之間存在著買賣合同法律關(guān)系,大數(shù)據(jù)交易平臺(tái)是以營(yíng)利為目的的商事主體。[結(jié)果/結(jié)論]基于大數(shù)據(jù)交易之商事交易的本質(zhì)特征,認(rèn)為大數(shù)據(jù)交易應(yīng)以交易安全為終極價(jià)值目標(biāo),以交易安全和數(shù)據(jù)自由流通為原則,并通過行政法規(guī)確立自律監(jiān)管與行政監(jiān)管并行的監(jiān)管模式,由政府部門和大數(shù)據(jù)交易平臺(tái)分別承擔(dān)監(jiān)管職責(zé),并按照政府部門整體監(jiān)管、大數(shù)據(jù)交易平臺(tái)具體監(jiān)管的原則各自監(jiān)管。同時(shí)立法中應(yīng)明確各自的監(jiān)管范圍,明確法律與行業(yè)規(guī)范的邊界,對(duì)于交易主體、交易范圍、交易價(jià)格、交易質(zhì)量等不同的監(jiān)管事項(xiàng),確定法律與行業(yè)規(guī)范分別監(jiān)管的范圍。
[Abstract]:[objective / significance] under the strategic background of implementing national big data, China's big data transaction has shown a rapid development momentum from the very beginning, but because it has not formed the standard trading rules and the inherent transaction risk of big data transaction, The need for legal regulation is increasingly evident. [method / process] on the basis of analyzing the practice of big data transaction in China and the trading rules of big data trading platform, it is concluded that there is a legal relationship between buyer and seller in big data transaction. Big data trading platform is a commercial subject for profit. [results / conclusion] based on the essential characteristics of commercial transactions in big data transactions, it is considered that big data transactions should take transaction security as the ultimate value goal, and take transaction security and the free flow of data as the principles. And through the administrative regulations to establish the regulatory model of self-regulation and administrative supervision, by the government departments and big data trading platform respectively to assume regulatory responsibilities, and according to the overall supervision of government departments. Big data trading platform specific regulatory principles of the respective supervision. At the same time, we should make clear the respective supervision scope and the boundary between the law and the trade norm, and determine the scope of the law and the trade norm respectively for the different supervision items such as the subject of the transaction, the scope of the transaction, the price of the transaction, the quality of the transaction, and so on.
